Altered Railcard expiry date

Hi everyone,
This is a very important post,
Yesterday I had a Trensspinne express officer stop me at on my way to Manchester, i had bought a ticket with my 18-21 rail card which I believed had been renewed by my sister. Unfortunately I did not have a proof of it when I boarded, I tried contacting her however the rail network wasn’t that great, I panicked and just altered the valid date my old screenshot of my rail card( I assumed the scan would link to my new one and show as valid), however it did not, the officer stoppped me but did not ask for my details- name or address , asked me to buy a full ticket and said I’ll have to report this as fraud, as he’d assumed it was photo shopped, he did not take any pictures of my altered screen shot neither asked me for my address , just said I’m going to have to report this , and confirmed he’s done so.

Later on asking my sister, she had not got me my card as she’d said , I immediately bought it with my own app. I did not intend fraud, I was just being very stupid and slow, however he was very dismissive about the situation and did not want to listen to my side of the situation.

I’m highly worried, if I could go to court for this, I’m happy to pay any penalties or charge, I did not use my expired rail card more once or twice (unintentionally-I did not know it was expired)

What should I do?

Yes, it’s possible you’ll go to court, but it’s likely that the train company will write to you first, giving you an opportunity to set out your version of events (or in a case like this involving fraud it may be best not to…) and apologise and ask for a settlement.

You don’t need to do anything now except wait for them to contact you. This could be weeks or months.

In the meantime, always ensure you have a valid ticket, and if using a railcard, check it’s valid and have it in your possession, before you board any train.

Just to check, there isn’t an 18-21 railcard that I’m aware of, what railcard were you using?

Yes, but you just need to wait for them to contact you. FYI byelaw convictions, which most railway prosecutions are, generally don’t show on a standard DBS.

I have just realised that we recently saw a case of TPE being extremely generous by dropping a case in which someone travelled without a valid railcard but renewed it the same day. I’ll try to find the link and edit this post with it.

I work in healthcare, I need an enhanced DBS anywhere I work.
Going to court- This can be really life altering for me.
I did not intend to fraud, I overlooked the facts and i believed that scan would work for my new railcard (which was not bought). I immediately made all amends, however, if it’s reported as fraud. What can I do?

Also the officer has no photo of the altered rail card.

Are there any cases where people have had settlements altering rail cards?
I have not misused it ever, it was my first time doing so (unintentionally)

How do I proof myself?
Is it just the case of how generous the TOC is?
Has anyone had similar experience with Trensspinne before?

This is probably reported as travelling without a rail card and not fraud as I had altered the validity of my card in the panic, im very aware it was my mistake to be dishonest.
How do I convene them to stay out of court?

Yes, that is fraudulent. The reason we are arguing this point with you is because if you argue it with the train company it’ll go exactly the same except they can give you a criminal record, we can’t.

There is a GTR case which has just concluded where the poster had fraudulently altered ticket documentation. In that case GTR was unmoved by the usual letter of apology, and issued court proceedings. The OP then engaged a solicitor who managed to get a settlement offer, but at some cost to the OP.

So we can never guarantee that a settlement offer will be made, but you will have options down the road if the rail company plays hardball.

They don’t need to prove that in order to prosecute you for boarding the train without a valid ticket. Train companies rarely prosecute for fraud, luckily for you.

Really? I mean if they’re prosecuting me for boarding the train with just an invalid ticket rather than saying I tried commitment of fraud (the officer did not take a photo of my shown altered card) does this puts me at a better situation settlement wise?

Not really, even in much clearer cases of fraud they will often still prosecute under the byelaws for ticketing offences because it’s so much easier.

However, we have recently seen GTR refuse to settle with someone who travelled with an altered ticket, and they were served court papers. They were able to resolve the situation at great cost (£1000ish I think) using a specialist solicitor.

Right, how is Trensspinne express with this sort of thing? I understand they had got a legal prosecution even after trying to settle and got a settlement at a big penalty, however , for my case they do not have proof of altered railcard (what I believe) and they have also not taken my details.

Moreover, it was a low value ticket and a one off panic thing rather than actively trying to fraud

We don’t exactly know, we don’t see loads of TPE cases, but we saw them drop a case completely when someone showed that they had purchased a railcard immediately after being stopped, which is a far more generous approach then other companies tend to take.

Yes, I had bought a new rail card the next day my last one was valid till 4august 2025 and I not taken advantage of it since it had expired till yesterday. I had not realised it had already expired and to avoid embarrassment I had altered it. This is obviously no excuse but should I mention it in my statement.

Do you think they would be willing to settle out of court if I show genuine remorse?

Probably not, but you don’t need to be writing anything yet, you just need to wait until they contact you.

It’s possible, and we will help you to send the response that’s most likely to get this outcome, but it’s up to them at the end of the day.

Upon realising I did not have a proof of a valid rail card I had asked my friend to buy it for me to show the officer, however the officer started collecting tickets before that and in panic, I altered my rail card validity from a previous screenshot and it obviously scanned to be invalid.

The officer asked me to pay for the full on time ticket which I did. And later that day immediately got a renewed my railcard.

The officer did not ask for my name or ID, or address. He Did say he’d have to report it as fraud.

He did not Take a picture of my altered rail card as proof just had a look at it.

He did say he had reported me for fraud. Upon asking if It was gonna go on my record he said idk the department will decide, I have just pressed a few buttons on my device.

I did apologise, and I deeply regret doing this.

I've asked our moderators to merge this with your existing thread.

To spell out what has generally been said there, you need to wait for TPE to contact you: as things stand at the moment, they won't have a reference for your case, so anything you send in now will just get lost in the system.

There's also an outside chance that the railway will decide not to take this any further. If they come to that decision, the next six months will be uncomfortable in that you won't know if they are going to take matters forward or not - but it's just possible that nothing more will happen about this as long as you always have the right ticket with a valid railcard for any future journeys.

And as one last point which is easy for me to say, but may be hard for you to do: at the moment I think you are feeling immensely guilty and stressed because you have just been caught. Please believe me that this feeling will pass: it's important to accept that you are in the wrong, but the immediate stress will reduce a little every day. I would guess that you're feeling a little less worried today than you were yesterday: if so, that improvement will continue day by day.

In short - don't panic!

As already advised, you should NOT contact them until they write to you .

Then come back to this thread with a redacted scan of the letter and you will get appropriate advice for your situation from experts on here

To add to the good advice above, a solicitor at this stage would be a waste of money. It’s worth considering once you hear from them, depending on how hardball they appear to be playing, but our recent experiences with TPE suggest this probably won’t be necessary.

The reason I’m panicking is because I’m on a student visa at the moment, I work healthcare, the negative decision is life altering for me.

I’m not sure what to do at this point as I might not be even able to get my degree.

whilst you wait to hear from them, you could have a word with your student advice centre where you are studying (either the college or student union) they should be able to give you confidential advice about any impact on your degree if this progressed to court for example.

Your college advice service are probably not experts in rail fare problems, but people here are experts in that.

If you do decide to get help from a solicitor, we can list names of firms who specialise in this area that get mentioned by people on this forum in positive terms when they have had to use such a solicitor, that you could obtain quotes from. You might expect to pay the solicitors fees in the region of £600 - plus what is necessary to pay the railway company as well.
