Hook handed cleric Abu Hamza and four other Muslim men - some of whom have been held without charge in Britain for more than a decade - look set to be extradited to the United States within days after the European Court of Human Rights threw out their last legal lifeline.

The men are all wanted by American prosecutors for alleged involvement in violent Islamism and have fought a lengthy legal battle to avoid extradition. But in a final blow to their hopes of staying in the UK, European judges last night rejected their attempt to appeal a ruling from earlier this year which said their extradition could go ahead.

The decision means the Home Office is likely to push ahead with flying the men Stateside within the next few weeks.

I know it was not very politically correct of me to laugh out loud, but I could not help it when a neighbour called and mentioned, in all innocence, that "Abu Hamza had finally been told to "sling his hook" ". when desribing the turn of events concerning this individual today.

Has anyone any views about this person ?

My views on Abu Hamza are obviously tainted (more than tainted!!) by the information supplied by the media. I do not know him, have not heard his views first hand, and I consider therefore that it would be a little presumptuous to come to any conclusion on him based purely on media reports.

But if what has been written is even a small percentage true, he deserves no time in my Country.

Like the OP I'll believe it when I see him on US soil. I just hope that people remember this during the (almost) daily minute hate of the EU.

It's the European Court of Human rights not the E.U. that's turned his appeal down.

As long as we remain in the E.U. we have to sign up to the Court also.

It's this court that has prevented him being extradited for years he would have been long gone if it wasn't for them.

I would imagine that it will be turned down sharpish

Then of course he will go down the medical route of claiming he's to ill to be extradited.
I would imagine his lawyers are already thumbing through the medical text books to find a suitable ailment.

This is the bloke who cost the tax-payer £10,000 when he claimed his shoes wouldn't go on because he couldn't cut his toe-nails.

High court judge stops the extradition.

You really couldn't make it up.

Even if the court refuses this further delaying tactic they may let him appeal. Will this multi-million legal aid birthday party ever come to an end.

The whole thing is becoming a farce now, presumably if he loses this High Court appeal he will then go back to the Human Rights one based on what the High Court said.

They're not on anybody's "side".

If the European Court has already ruled that Abu Hamza and Khaled al-Fawwaz can be extradited, how can they hope to stop the process?

The simple answer is that they have to prove to a judge back in London that there is some new and compelling factor that has not been already considered by all the court hearings going back years.

An interim injunction is just that - the attempt to halt extradition may be over within days.

The injunction does not mean the men have a sound case to avoid extradition, only that the High Court wants to hear the arguments in full. This kind of application and hearing is part of the standard cut-and-thrust of the legal world.

If a judge rejects the applications, the extradition is back on, unless the men get permission to appeal.

An appeal should contain compelling new evidence.

I cannot understand why they were ever allowed in the first place as they were simply another delaying tactic of no merit whatsoever.
