If someone operates a 'heritage' bus service is there a way they could take it that extra step and allow people to smoke on the top deck ?
I was thinking along the lines if someone wanted to recreate the atmosphere that led John Lennon to pen the line 'found my way upstairs and had a smoke - a line which is probably lost on many generations but with the popularity of the Beatles is something some people would want to recreate.

There are certain aspects of heritage vehicle operation that are allowed to circumvent certain laws (the DDA for instance) and I was wondering if there was a similar loophole regarding the smoking ban.

Closed top bus - If the bus is only being used for private hire then the smoking ban may not be applicable, as it applies to enclosed public places and workplaces, which may be the stumbling block if it counts as the drivers workplace, although if its the owner this may not be classed as a workplace neither.

To properly recreate a 60's atmosphere you would probably need to ask for two dozen volunteers to sit on the top deck and smoke for a week to recreate the nicotine stained ceiling effect.

Technically I suppose a 'private party' staffed by 'volunteers' may be the loophole.
It probably sounds a bit odd but some people do an awful lot to recreate an authentic nostalgic experience. It's probably more likely than an un-air conditoned Cavern in a dank cellar allowing people to smoke to recreate the atmosphere.
