    Failure to consent to it, would automatically involve a court case with the risk of costs being awarded against you, just as with a parking penalty notice, or a ticket for street urination. The caution, or penalty notice if one prefers, would replace the 'penalty fare'.

    There are lots of relatively early finishes and late starts. Is that deliberate? You could get a good many local lines in if you tried. Assume Inverness-Paddington is a Caledonian Sleeper plus tube journey?

    1330 FSR Edin-Aberdeen will be 170 or 158. 1340 is EC HST Aberdeen- Inverness is mostlikely to be a 158 but a 170 may be used on occasion. Glasgow- Paisley return most likely 334 or 318.

    With a regulator paid for by the members who are regulated, but run independently they have an interest in minimising claims by training their own staff etc. You could make it tax payer funded but at a time when we are trimming the public sector I don't see DfT increasing their staff count...

    Because appealing to a TOC gives the TOC employee a vested interest in denying your appeal as they have a budget. Independent but paid for by members is a more common regulatory mechanism.

    Hence why we a penalty fare should IMo be like a caution and after 2 cautions you are prosecuted via courts for fines, compensation and costs as Northern have recently. I would also have an independent Penalty fare appeals body paid for by ATOC but run independently.

    Nexus has been doing this for years. They used to publish a poster of metro fare evaders prosecuted every month with Name, Age, Street, Town and Fine. They used to fill a poster in size 20 font!
