Son’s phone ran out of battery - ticket inspectors told him he could appeal. But been rejected

Quite so. I think this is a prime example of how the penalty fare regulations need amending to make this sort of issue easier (and fairer) to resolve.

Son’s phone ran out of battery - ticket inspectors told him he could appeal. But been rejected

I agree that it is incredibly unlikely that the railway company would decide to sue a 13 year old but that isn’t to say they couldn’t. The parents might not be on the hook but the child could end up with an outstanding judgment to pay once they turn 18.

Son’s phone ran out of battery - ticket inspectors told him he could appeal. But been rejected

On what basis do you advise that the penalty fare is unenforceable? Children are able to be sued in England and Wales and the penalty fare regulations explicitly provide for unpaid fares to be recovered as a civil debt. In the case of most debts the child’s lack of competence to enter into a...

EMR - Trainee Train Drivers - Recruitment Discussion

I’m also in the Kettering talent pool, since January this year. Last I heard (possibly on this thread) was that they were oversubscribed. I’m working on the assumption that my 2 years might come and go without a job offer. If I get a call then that will come as a pleasant surprise.

GWR - Trainee Train Driver - Recruitment Discussion

Doesn’t seem so although apparently LNER are recruiting for future drivers for King’s Cross atm. It isn’t on its recruitment site though: https://spkl.io/6045fqmMb They also have Newcastle: https://spkl.io/6046fqmMj I suppose I should’ve put a new thread for them

Caught with expired railcard, being fined for journeys when it WAS valid

It sounds like you’re fine then. Please disregard my earlier comments, I had misread your first comment as the ticket inspector had discovered your card was out of date, rather than you discovering it. As others have correctly said, the prosecution would have to prove dishonesty for fraud...

Caught with expired railcard, being fined for journeys when it WAS valid

It all depends on the available evidence, doesn’t it? I don’t think there’s enough information in this thread to make a decision. Was OP interviewed, or did he make any admissions at the time he was stopped? What did he say? Is there some other evidence available to suggest that OP knew it had...

Caught with expired railcard, being fined for journeys when it WAS valid

I was 9.5 years a police officer. I know the points to prove for fraud, and as I say it is not as straightforward to prove as the Railway Byelaws offences. As you quite rightly say, the prosecution would have to prove dishonesty and an intention to make a gain for himself. Ultimately, it boils...

Caught with expired railcard, being fined for journeys when it WAS valid

I wouldn’t recommend ignoring it, despite what others have said. Yes, fraud is harder to prove than a straightforward breach of the Railway Byelaws, but is that a risk you are willing to take? I would make a counter-offer to settle excluding the amounts for the journeys for which I had a valid...
