What plonker makes the same mistake twice in one day?! Gets "done" on the outward journey. Potentially could have gotten FCC to accept his story.
On the return, gets busted again!!
But surely some discretion can be used?
Everyone forgets something and this time it just happened to be my railcard.
I even managed to get from London to Sheffield and back the other week without being asked for my railcard...consistency is needed!
Believe what?Got a travelcard with a YP Discount (however had forgotten my Railcard) on the 23rd December and used it all day around London then at 4:45 trying to get through London Bridge they've put the filters on not to accept tickets with railcards, now this is slightly odd as during the 3 years I've had a YP Railcard and got travelcards I haven't been stopped, ever. The ticket barrier guy (he looked more like a train guard) wouldn't believe me

Well, a Penalty Fare is applicable for you both, but if you refuse to pay it then prosecution is likely. The PF does not have to be paid on the spot, it can be paid later, but the excess would have to be paid there and then. Was she issued with a PF in the end? If you swore at the member of staff that is not going to help.The annoying part of this is that I got one for my gf and as putting the railcard discount on the ticket machine is programmed into my head now and I didn't realise my mistake until London Bridge whilst being moaned at by the guy. Now my gf offered to pay a penalty fare by debit card but the guy refused and said only cash was acceptable and wouldn't let us go out to the ATM to get cash. He was unproffessional during the whole ordeal and had a smug smile on his face the whole time, not to mention he didn't speak English very well so was hard to understand...it got to the point where he was just being a total ******** so I let him know what I thought of him.

You were not accused of not having a ticket. You were charged the correct fare for not holding a valid ticket, which is a Penalty Fare. This is the charge made in PF areas for honest mistakes. If you showed any intent then it could go straight to prosecution. Refusal or failure to pay can also result in prosecution.It's not like we didnt buy a ticket or such.

If you had the Railcard and showed it you would not have been asked to pay a PF! You're (presumably) a member of staff, rather than a member of the public. I don't think it's reasonable to expect a customer who follows the 'lost ticket' procedures laid down on TfL's website to know that TfL's and NR's procedures for re-issuing the same ticket (z12 Travelcard) differ in a way that invalidates one of the benefits associated with that ticket type. And I doubt a court would think that, either.
In general, I love the railways and I appreciate the hard work members of staff put in. The one area where this *isn't* the case is the habit of staff members - both on trains and on forums - to blame customers for things which are clearly the railway's fault.

In all the years I've been shopping, I have never been stopped at the exit and had my receipt checked against purchases. If it happened to me tomorrow and I had items in the bag that had not been paid for do you think the same would apply? Hmm I'm sorry officer, I have shopped here for 10 years and no one has ever checked me leaving, so I don't think you should've today either.

In this case, a communication failure between TfL and NR was at fault, with the two organisations' ticket reissuing procedures having been made obsolete and incompatible by the arrangements associated with the launch of Oyster. There is no reason for a customer to assume in advance that this is the case - in general, you assume that the company you're transacting with is broadly competent and knows what it's doing. Instead, you find out that this is the case when an RPI demands money with menaces (and slags off TfL to boot).

I think, AlterEgo, you may have conflated NathanPrior's issue (Y-P ticket without Y-P Railcard) with johnb's separate issue (gold record card not issued with annual season ticket on Oyster).
Indeed, if London Bridge is a CTA then 17 is applicable.
We have been able to provide very effective assistance to others who've been detected without a valid ticket or other documents, though I'm not persuaded that this is one I will be assisting, for the same reasons that others have given. Particularly as it is now so late in the time offered for the passenger to provide a Written Statement.. . . . So I've replied with the truth that I forgot my railcard and have attached a copy of my railcard with the letter
The one thing that does concern me is why a debit card was refused, apparently without knowing what sort of card it was. I'm sure PFs can be paid by card as long as the card is valid for offline transactions.
Not all RPIs carry an Avantix machine, but surely the customers could have been escorted to a booking office to take payment? I can see why he wouldn't necessarily let them use an ATM (cue Daily Fail headlines "UNEMPLOYED PASSENGER MARCHED TO ATM OVER £2.70 FARE") but unless it was a Visa Electron card, it should have been accepted.
