From my understanding ASLEF have a no rest day working policy but will sanction temporary periods of rest day working during driver shortages in order to keep services running as long as TOCs are making every effort to train new drivers.

I stand ready to be corrected on this but I suspect the original dispute centred on the filling of existing vacancies rather than creating new driver posts.

Boing uk points out that the law states only that the employer and employee must sort out how leave is allocated.I would submit that the driver in question applied for his leave and had it granted under such an arrangement.Even if the company is within its rights to cut back on leave granted surely that should only apply to applications made on or after the date on which the change was made.

Scotrail will no doubt claim the change was made in order to ensure the level of service, thus surely justifying ASLEF's original gripe.

A very sensible post, thank you!

The drivers should stop all restday working, and stick to the rostered hours of the job they are on.
If there is owt wrong with the unit, do not take it out on the road.
If one man has been demoted, it will be a trial that management would like to win, cos who else is next
As for HR I dealt with these so called managers for many years, and would not trust them as far as I could throw them.
I know when there 's plunder to be made, the daily sheets will become important when everybody wants to work RD's
I have seen fights break out over working overtime, as men go down the rosters say that my job not his etc.
Remember that all loyalty to your fellows ends at 00:01 on a Sunday when it was time and three bits.
When overtime is in the offing, drivers would see their mates down the road for an hours over time.
Ask the guards that were sacked because of the introduction of DOO(NP)
as driver got an extra £7.20 per shift for DOO.

I am a driver, but this is correct. Also true is the fact that the driving grade sold guards down the river,as they did their secondmen in 1988 (i know,I was one and had to become a trainman and do guards jobs)
I dont do overtime, but have seen my mates pull other drivers off turns because of greediness. Not all do it but some are terrible.Always promised myself I would never go down that path.

If some punter rabbits on again about 'I pay your wages' I can only reply 'Good.. That's why the fares are going up by 6%! :D
Sorry but it's true. It is that old chestnut!

Appalling! Have you any idea how the world works?

Attitudes like this almost make me want to become anti-rail and start campaigning to curtail taxpayer subsidy of the railways, which would have to be drsatically cut back with attendant massive job losses. Then see how smug you'd be!

There are some very odd views about 'entitlement' and a prevalent 'the public owes me a living' attitude among some on here. A complete divorce from economic reality. I can only presume it stems from old public sector BR days, and encapsulates much that was bad about BR.

How much of the government subsidy goes to Network Rail and how much goes to the TOC and how much does the TOC payback to the government through out the life of the franchise?

...and to answer CS's earlier question, the last time I looked my employer paid my wages.

Hmm, my impression was that you thought the guy and his union were out of order, apologies if that wasn't the case. Always gets a little heated when you combine railway unions and forum trolls... (I'm not referring to you there!)

The irony of someone who mentions companies treating their staff with respect yet deosnt treat others with the same respect who have a different view to his

I fail to the irony.

Where's the similarity in a contract (of good faith) between employer/employee and random names on an internet forum?

Especially when you consider it's the same condesending 'names' that seem intent on spoiling and getting members backs up.

A certain troll on here continues to bitch about 'I pay your wages' - no,he doesn't but will not accept that.

I fully expect this post to be deleted as have the others i've posted showing him he isn't quite as clever as he seems to think he is.

Go for it Mods, you know best

You demonstrate short sightendness. Look beyond - who do you think pays your employer so he can pay you? Assuming you work on the railway, it's the public of course. Either through taxes or fares or both. There ain't no other source of income!

Not much change in the ethics of the press and their photographic agencies from what you have said, despite all recent events and "soul-bearing" before the Select Committee.

You could use their actions to define Doublethink, insincerity and crocodile tears . Nothing will change with the press since they have the power to decide who gets elected with their propaganda. Trial by media is a devastating issue but given the aforementioned control over the government it's one that will never be mentioned. Innocent and guilty alike will have their lives irretrievably damaged by often unfounded allegations, intrusion onto one's private life and poorer job prospects amongst others.
I hope that one of the things to come out of this debacle with the press is a law stating that a suspect cannot be named or photographed until a jury finds them guilty. If found innocent they their name is not revealed

The propaganda in this case being that the driver pulled a sickie without mentioning any other circumstances.

and his mobile phone rang with a tone revealing he was abroad

How would a tone reveal you are abroad?

The dial tone sounds different to that of th UK. However it only proves/suggests that the phone was abroad, not the person concerned unless answered.

It would seem not. You don't appear to have an idea how rail in UK is funded. The petard is where you left it; help yourself.

Of course it is a mix of tax and fares that pay our wages, we do all know that but lets face it, there will never come a time where rail services are not used. Given the high prices and shoddy services at the moment do you really think anyone takes the train to work every day by choice? But still they cram in like sardines. Take the trains away and the country would stop. Roads would be beyond gridlock-if a brighton to London peak train takes over 1000 people into Victoria each morning then Imagine just those 1000 people alone trying to drive in/cram onto buses etc.

Not saying that it's ideal but our employers are the ones who milk it-making no effort whatsoever to invest in the service above what the DfT insist they do and putting fares up beyond inflation. If they can do it and make huge profits for themselves and their shareholders then why shouldn't we have a bit of the reward? After all we are the ones doing the work and taking responsibility for all the extra people cramming onto trains year after year despite the best efforts being made to price them off...

A-Driver i think you are correct regarding commuting, at least in London. There is no other viable means of getting that many people into the capital and out again. Where rail could easily get the chop is anything outside the London commuting area and some main lines (WCML, ECML, West of England ML, and maybe a few others like Trans Pennine).

I am well aware how rail in the UK is funded. What I am challenging is your notion that because you (and others) are a tax payer it automatically means you pay my wages.

Perhaps the tax goes towards new trains, upgrades, projects, developments, station improvements etc etc.

Your argument is pretty weak without any hard figures about whos tax goes where and in which area they are used.

The railway is funded from two sources: tax from the UK taxpaying population, and customers (fares and income from freight flows etc). Thre's no other sorce of income I'm aware of. Are you?

Tax doesn't particularly directly fund capital investments like trains, upgrades etc (though it sure does indirectly). It pays a large proportion of the cost of the day to day running of the railway as well.

Scotrail management have been extremely weak in dealing with the driver who pulled a sickie. The driver should have been sacked as he has lied, deceived, committed fraud and the whole mess would come under GROSS MISCONDUCT. I myself was taken off train driving duties back in 2004 for a lesser offence and ASLEF were quite happy with my punishment of the sliding scale. Not even a whimper about a strike ballot from Mr K Lindsay, double standards from the leader of Scotlands train drivers.

Golden rule on the railway, keep your mobile off, dont go road learning on the golf course, and tell TOPS that the train arrived on time and left on time, and do not go where TV cameras are filming cos somebody will see you on the Docks at Liverpool, when you should reviewing the road Barnsley via Horbury Junction.
If you are found out deny everything and blame the shed cat.
Me and my mate were road learning Ellesmere Port, but decided to have a look at Liverpool Docks, when Richard and July had a TV show on the docks.
My mate suggested we go and have a look.
I nearly died of shock when he said that.
This chap now is a driver for FL Heavy Haul. That was 17years ago. Tempus fugit.

How can you say that tax does not directly fund CAPEX schemes? Are the tax and revenue streams separated before being used? Or have I misread your statement?
