I was reported by SWR in January 2026 after travelling using a Railcard-discounted ticket without holding a valid Railcard. I received a Travel Irregularity Report at the time.
Over four months later, I have now received an email from an SWR Investigator stating that they have identified "potential inconsistencies" within my online ticket purchase history and inviting me to respond within seven days before the matter is referred to their case management team.
The email does not specify any journeys or request explanations for particular tickets at this stage.
I admit I have been using a railcard that had expired for just under a year but since I was caught I have stopped doing so.
I would appreciate advice on how best to respond and whether members have experience of SWR offering out-of-court settlements in similar circumstances.
Email from SWR below:
On ********, you presented ticket number ********** at Surbiton to a member of Revenue Protection. Upon questioning, it was established that you did not hold a valid 26-30 Railcard for the discount applied. You were issued a Travel Irregularity Report, number **********.
Further investigation of your online account has highlighted other potential inconsistencies in your ticket purchase history. This suggests that you may not be paying the correct fare for journeys made on the UK rail network.
Given the serious nature of this matter, we have taken this step to contact you and initiate a resolution, prior to escalating the matter to our case management team.
Please respond to this letter via email to: *************** within 7 days quoting the reference number *************** in the subject field.
Potential response:
Thank you for your email regarding reference *****************.
I acknowledge receipt of your correspondence and take this matter very seriously.
Firstly, I would like to apologise for the incident that occurred on ** January 2026, where I travelled using a ticket discounted with a Railcard that I did not hold. I fully accept responsibility for this and regret my actions and the inconvenience caused to South Western Railway.
I note your comments regarding potential inconsistencies identified within my online ticket purchase history. I would like to cooperate fully in resolving this matter and would be grateful if you could provide further details of the concerns that have arisen, so that I may understand the issues being raised and provide an informed response.
I am keen to engage constructively and, if possible, would welcome the opportunity to resolve this matter directly with South Western Railway without the need for formal escalation to the case management team.
