GWR Expired Railcard 2024

Please help, I am in a state of major anxiety and I can’t sleep.

I got off at bath spa on 16 June 2024. I was stopped by an inspector as I had an expired rail card and was interviewed extensively. I explained that it was an innocent mistake (which it was) and negligence on my part. I was happy to pay a fine or pay the difference in fare.

I haven’t heard from GWR since today and I’ve been asked to provide evidence of a rail card from 2022 until 2024. I am pretty certain my card was still valid up until a couple of months before I was stopped but I don’t have the physical card to confirm this.

I am happy to pay whatever fine but I’m terrified of going to court. This was genuinely an innocent mistake and I have been so cautious with rail cards since. Somebody please help, I feel genuinely suicidal from the stress.

If you were stopped in 2024 you cannot be criminally prosecuted. Effectively you owe them some money since you had an invalid ticket. They're asking about your Railcard so they can work out how much they think you owe. They will probably ask for more than you strictly owe originally (in my and other poster's opinions) and it should be possible to reduce it by negotiating with them. However there is no penalty available to them beyond charging the amount they ask for.

For now do your best to provide the evidence they are asking for. Look for confirmation emails of your Railcard purchases, if you can find a Railcard number on it then the email should be sufficient evidence for them. Then wait for them to respond with the amount they think you owe. If you're correct that your Railcard wasn't expired for long then you won't need to pay much but it's probably best to make sure you have a few hundred £s saved. You probably have at least a few months to get that sorted so don't panic.

To be clear: you cannot be criminally prosecuted if the offence was over 6 months ago. At the worst you might have to go to civil court if you argue with them how much you owe (and this may be sensible since they will likely ask for more than they could get at court!) but you can definitely avoid court by paying them what they want if it's really stressing you out.

Just in brief don’t get distressed about this as plenty of people here can give you really good advice on your options if and when anything actually happens.

I hope this reassures you.

One thing you can do is see if you can look through your old ticket buying records and work out how many occasions you might have bought tickets with a railcard reduction when your railcard had expired. List out that info for yourself and keep the list safe.

Then also dig through old records you can find if railcards you did have and their start and end dates. Anything you can find will help. Make a list of that too and keep any evidence you find saved carefully. This could be helpful in due course if you can find things.

These are just practical things you can do now to be prepared for anything that may happen.

Also as explained the worst that can happen is a court civil debt action aiui.
Obviously in an ideal world you don’t want that but that is on a par with what would happen if you didn’t pay an electric bill or credit card debt I think.
They list the chance to take firmer action 6 months after the date they stopped and questioned you about this.
