GTR admits to operating their four brands

Their website says this:
We are the UK’s largest railway franchise, operating Southern, Thameslink, Great Northern and Gatwick Express...

When GTR first took over the franchise, their staff on on the Gatwick Express route used to deny that the trains were "Thameslink services", deny that the trains were "operated by Govia Thameslink Railway" and deny that the company was "Govia Thameslink Railway Ltd"; they went to great efforts to lie to passengers in order to justify the charging of premium fares.

Some GTR staff used to go to all sorts of elaborate efforts to deny this, for example by claiming that GTR was an "umbrella company" and that each of the brands was a separate company in it's own right; other staff claimed that each of the brands was a "company for the purpose of ticketing" (whatever that means).

But now, there is no such denial, and I believe that such arguments appear to have been discontinued, and staff now freely admit that it's all one company, as confirmed on the GTR website.

Any passenger using a "Thameslink Only" ticket can use the GX service with more confidence that staff won't make up all sorts of bogus claims how GX is a "company" or "operator" any more.

If anyone is incorrectly charged a new fare, excess fare or penalty fare when using such a ticket, they are absolutely entitled to argue that the ticket is valid, as it's restricted to the company that is indeed operating the service and - if wrongly charged - is absolutely entitled to a full refund and should lodge a formal complaint.

I am aware of forum members who have used Thameslink Only tickets on GX branded services many times without charge, though I understand a very small number of staff do continue to argue such tickets are not valid. Any evidence of wrongdoing should be properly logged, and documented, and formal complaints lodged as appropriate, as this could prove useful in the ongoing legal case against GTR.

Is there any legal way a train company could operate a premium service? Just curious. I use use GX most days, with a season ticket any permitted route.

Not within the scope of the Ticketing Settlement Agreement, no.

The TSA permits operator-specific fares, but not brand-restricted fares.

GTR have been breaching the TSA ever since they took over, albeit under the direction of the DfT.

As well as pretending each brand was a company in its own right, their other argument was that they didn't "create" the fares and merely inherited them. However, had they simply read the TSA, they would have discovered that any company inheriting fares is immediately deemed to be the creator.

Sone operators charge premium fares between premium locations and an airport, e.g. Greater Anglia charge huge premiums from London to Stansted, and also under a supposedly premium brand, i.e. Stansted Express, in the same way GTR operates GX. However, GA didn't create unlawful brand specific fares and the premiums can easily be avoided by either splitting or purchasing a longer distance ticket, valid via the airport.

GTR are already in the business of charging a hefty premium from London to Gatwick, without considering GX, as the non-Express fare can be reduced considerably by splitting at East Croydon.

I believe that over time GTR management have realised that the previous position they originally maintained has become increasingly untenable. I also suspect they understandably don't want any legal ramifications for implementing unlawful practices at the request of the DfT.

But still the overcharge is occuring, as the vast majority of tourists and other users have absolutely no idea about any of this, and many people are either unexpectedly charged more than they thought, or just don't realise they are overpaying.

Classify the whole train as "standard premium"? I'm sure there's a loophole somewhere but maybe it's best not to give them legal ideas...

At least it won’t be as bad as the “first class” on a 387. I’m not sure if they are allowed to have a train without standard class.

Pullman trains were first class only. Airport express trains "only conveying first class" are not entirely unusual on the European mainland. I seem to recall that being used in Italy for certain, though it didn't look very first class!

Milan, I think.

I wonder how many people have cost their company a more expensive taxi fare thanks to inflexible expenses policies. I don't recall the "1st class" fares being all that bad.

Pullman trains were first class only.

I don't suppose that means that it's allowed under the rules set up for privatisation. It might be something that was considered worth preventing.

If I buy a Super Off-Peak Travelcard am I fine using it a train from PRP to VIC? Will it work the barriers at Victoria>

You may be challenged for doing so and may receive an MG11 or Penalty Fare. However @yorkie who knows well about this can assist in what to do if this does happen.

If offered a PF definitely take it, it is much easier to deal with and get dropped on these grounds than an MG11. If a PF is refused an MG11 usually results.

No, it is a Travelcard. The "Thameslink only" only 'applies' outside the zones (ignoring the brands argument - which while I agree with the cause I wouldn't have the appetite to test in practice). I certainly wouldn't use a Gatwick Express service which will deposit you at a separate gate line at Victoria (I don't think Preston Park has GX services though?).

Or just use Thameslink. It's ironing boards either way.

The Gatwick Express barriers are set to charge a higher GX special fare when using contactless. I don't know but I imagine it's possible they'd also be set to reject non-"route GX" paper tickets.

We've had threads before where the special contactless fare has caused issues when non-GX services have used the GX platforms.

FWIW my Any Permitted cross-London day returns to Gatwick and Brighton have always been rejected by those gates in recent years.

I have certainly had issues with perfectly valid through tickets to/from MKC at that gateline. I think it indeed looks for Route GX or whatever it is.

The expensive fares they'd like you to buy are routed "Any Permitted". It's probably 'just' that they haven't programmed in the validity of cross-London tickets, because each flow needs to be individually configured to be recognised.

I see how operator does not equal brand, but how does operator equal owning company?
Does the TSA prohibit a TOC from designating one train as all first class and another as all standard class?
Perhaps there is a remnant of the Victorian law requiring third (what we call standard) class on a certain frequency.

The TSA says:
An Operator is not required on any train to make particular carriages available to the holders of Standard Class Fares or the holders of First Class Fares except (if it is a Franchise Operator) to the extent that it is required to do so by its Franchise Agreement

I don't see any requirement for GTR to do so in its current National Rail Contract, but I could be missing it. Of course that contract will not be particularly relevant from next weekend.

At face value yes but as GatEx services are non-stop Victoria<>Gatwick the staff at Victoria will know you can not have used Thameslink then changed at East Croydon ( Zone 6 boundary) on to Victoria.
While as stated above and many times elsewhere on this site GatEx and Thameslink are brands of the same operator so they can not discriminate between brands that is what could create an issue at the GatEx barriers at Victoria.

Roll on the legal case ...

Reference post #7 above, I cannot recall any Pullman train which didn't have 3rd/2nd/standard class (ie the class below 1st for those with short memories!). They did however require payment of a Pullman supplement which varied by class of travel and station pair. This dates to an era when all seat reservations had to be paid for (with a cut off of at least the day prior), although the Pullman conductor could sell the supplement on boarding if there were spare seats available.

Many people were surprised that the Gatwick Express services didn't become first class only when the GTR franchise rolled Southern (who used to operate Gatwick Express) into their operations.

Unfortunately, I still witness the on-board supervisors charge people excess fares/upgrades on an almost daily basis between Brighton and Gatwick, or tell them they'll let them off if they get off at Haywards Heath and catch a Southern or Thameslink service.

One particularly patronising OBS the other week said something along the lines of "You wouldn't get on an air Italia flight with an easyJet ticket". I wish I remembered the time and date as I wanted to make a complaint, the way he was talking down to her was completely unnecessary. I did enjoy questioning why he was asking to check my ticket on a Southern service whilst wearing his GX uniform the following week tough, seeing as he apparently works for a different company!

GTR have already started to change things on their website. It seems that GTR will be known as Greater Thameslink Railway which is a trading name of Thameslink Southern Great Northern Limited.

Interesting. If anyone is able to obtain any video and/or audio evidence of any such behaviour, I would be grateful.

Likewise if anyone is wrongly charged and is able to dispute it, I would be both willing to help as and also grateful for any such evidence of wrongdoing by GTR.

I've heard that people who buy a Gatwick Express ticket now get a discount on FastTrack at the airport, while those who buy a first class ticket get FastTrack for free?
