Greater Anglia Prosecution - seeking advice

Hi all, looking for advice on this peculiar situation I have ended up in;

I started my journey and Stansted Mountfitchet and ended my journey at Stansted Airport.

When trying to leave the station my ticket was not working, some kind of enforcement officer had a look at it, and basically said it's not valid as for that journey I had to have used a barcode ticket as they don't use paper tickets any more on this journey. Quite bizarre, as I bought my ticket on Trainline, and it specifically said the opposite, that I HAVE to use a collection code to print my ticket out. Which I did, obviously.

Long story short they wanted me to pay a fine there and then, and I refused, gave them my details and went on. Now I got a letter through the post stating they are prosecuting me etc and to pay an even bigger fine. Via a company called IRCAS. Im unable to appeal through their portal, so I called them, and they said to appeal I have to email in regarding this specific fine. I did so, made sure to include a photo of my ticket and my trainline booking email, and got the following reply today:
"Thank you for your email.
You were reported for traveling from a London Terminal to Stansted Airport however your ticket is only valid from Stansted Mountfitchet. This is not a London Terminal and so this makes your ticket invalid and you have been reported correctly.
The full amount outstanding is £120.40 and will need to be paid within the next 14 days."

So now they are apparently trying to fine me for a completely different reason?

Can someone advise me on how I fight this, please?

Where did you collect the ticket, and when? (The train company will know this information)

Which train did you alight from when you were caught?

Your location is listed in London, and this is where they allege you travelled from. Is that true, or not?

So you didn't travel from London at all - you boarded the train at Stansted Mountfitchet?

I'm not saying that's impossible, but I'm sure you realise it is rather improbable given that Mountfitchet only serves a small village. The overwhelming majority of people travelling to Stansted Airport will be coming from further afield, most from London.

Unless I'm misreading it, it appears your ticket was printed at Metrocentre station near Newcastle at 15:09 on the day of travel. How did you get from there to Stansted if not by train?

But some points that might help you to know ref points in your post

Given what I think they suspect it might help if you can evidence this in any way (evidence that ultimately you would be prepared to show in court - at least in theory - if you do not pay what they are asking), as they seem to believe you started your journey in London - did you say that to the member of staff who stopped and questioned you?

If that was what they said to you then that is certainly not true. Any ticket like this can be be used on any journey on the National Railway network. I buy tickets without barcodes on them all the time and travel using them without question.

I assume that would probably have been a Penalty Fare (strictly speaking this is not a 'fine' though obviously it feels like one) - for future reference a Penalty Fare is the least worst sanction for a ticket irregularity that can be issued to a passenger (apart from a verbal warning I suppose). Penalty Fares have legislation that governs their issue etc, which includes a 3 stage right of appeal. They are £100 (reduced to £50 if paid promptly) plus the price of a ticket

That's usually called a TIR (IIRC a travel or ticket irregularity report) triggers a back office investigation and / or letter requesting your version of events, or in this case a letter asking you to pay a sum of money to resolve it based on what they think you have evaded paying ticket wise - again this is not a 'fine' - it's basically an offer of an out of court settlement - ie if you pay this they will not take you to court for fare evasion.

There is no right of appeal (apart from letting it go to court, pleading not guilty, and seeking to persuade the magistrates that you have done nothing wrong.

However, if you can demonstrate to the railway company that you did nothing wrong they will often withdraw the case before they try to prosecute you.

Via a company called IRCAS.
They are a contractor that works for some railway companies over enforcement and ticketing issues. From what we see on here they are not easy to deal with unfortunately.

As above, there is no right of appeal like there is with Penalty Fares (so a Penalty Fare will have the portal for making an on line appeal but this can't be dealt with via that)

Well, there not trying to fine you strictly speaking - they are trying to charge you the correct fare from London (where they believe you started your journey) plus an 'admin fee' - do you recall being asked where you started your journey when you were questioned?

Were you given any paperwork by the person who stopped you? If so what does it say?

Two options I suspect
a) try to persuade them that the ticket was correct for your travel (ie you started your journey at Stansted Mountfitchet - eg if you stayed the night there in a hotel before getting a flight can you send them a copy of a room booking e-mail or some such)
if that fails
b) advise them that they will need to escalate the matter to court where you will present your case

(But - be aware if it escalates to court and you are found guilty the resulting costs (court fine etc) will likely be more than the sum they are asking for now, plus you will have a criminal record which may have other impacts eg job applications / insurance costs when answering typical questions insurance companies ask about convictions - albeit a relatively minor offence it might be said)

So if you have evaded any of the fare for your journey then my advice would be to pay what they are asking for to stop this escalating to court

Given it's IRCAS that are involved here I would expect them to want to see clear evidence that you did not travel from London before they drop this, and will almost certainly happily escalate it to court if they think they can win that. They will certainly continue to tell you that is what they are going to do.

There is only one train per hour calling at both Stansted Mountfitchet and Stansted Airport. What time did you arrive at Stansted Airport? Was that consistent with the arrival of a train which had called at Stansted Mountfitchet?
Which of those trains were you on?
The question of where you collected your ticket is also relevant. The timestamp of printing is 15:09. Watershed has an idea where you might have collected because that information is encoded in all the numbers. If you came from there, then to be charged a fare from London would be a big saving.

I worked a nightshift in the Cambridge area, (im a railway contractor, and i live in london), My friend/colleague dropped me off at mountfitchet on his way back to london. I stayed in mountfitchet because i found a hotel there that was way cheaper than next to the airport. Checked out around lunch time, had a few pubs and got to mountfitchet station early. Ticket was printed at 1509 as someone pointed out and the train was around 1535 if i recall correctly... I got the train i said i got to the airport, to go see some family in Europe. Simple as that

ill give them my hotel booking, not sure what else i can give them.

Daylight robbery attempt it feels like!

Nope, that's Metro Centre. 7725. Second grouping of four.

With a ticket apparently printed over 200 miles away putting a fairly severe dent in the story. One fact appears to disprove the other, whichever way you look at them.

But it appears to be unchallenged that OP was at Stansted Airport on the day. They tell us they were flying to Europe. So what timeline allows them to be in Newcastle at 1509? It's suggestive of the ticket having been issued somewhere else.

One day I'll just take the five minutes it will cost me to knock up a booking.com confirmation for Buckingham Palace as proof I stayed there too.

The ticket was printed at Metrocentre and undermines the OP's story. GA will already have audited all this and that's why they have a letter accusing them of short faring.

An itinerary will get you into Stansted from Metrocentre shortly after 8pm, i mean Stansted isn't exactly on the other side of the world from Newcastle.

It's always  possible that there has been a fault with the machine and printed the wrong NLC, but I  highly doubt it. Obviously it isn't possible to print a ticket in Newcastle 30 minutes before presenting it at Stansted, so either the machine is broken or OP has lied about their arrival time in Stansted. There's no point in lying on an anonymous forum, and GA will have noted the arrival time, so it's up to OP to confirm the actual events if they want proper advice.

There are obviously questions around the location the ticket seems to have been printed at, but if this story is true there must be a mountain of evidence around your movements that day. If the only evidence you have is a 'hotel reservation' then I don't think that will cut it.

...because if it's untrue, GA will have a mountain of evidence to prove that you are guilty, and they appear to be one of the more competent companies when it comes to these investigations.

I think my advice remains pretty much the same as in post #5, FWIW

ie

try to persuade them that the ticket was correct for your travel (ie you started your journey at Stansted Mountfitchet) - and be prepared to clearly and reliably evidence it

but
if the OP has evaded any of the fare for their journey then my advice would be to pay what they are asking for to stop this escalating to court (which has the potential to end badly).

I would expect IRCAS to take a robust position on this if they do not believe the OP, and will continue to threaten court (which they usually do even in cases where there is no question going to be asked about something like where the ticket was printed out).

Yes, certain journeys which are heavily associated with short-faring have been made unfulfillable to e-ticket. Wembley Stadium to London Terminals is another that jumps to mind.

The payment deadline has already passed, but even so I think a written letter with supporting documentation of the stay in the hotel (was it the Old Bell?) at Stansted Mountfitchet should be submitted. If GA proceed to prosecution and it has to go to court for a Not Guilty plea, the evidence will have to stand up in that case.

As for where the ticket was printed, the code for Stansted Mountifitchet Ticket machine is 5533, quite different from 7725 the code for Metrocentre.

As always, please post the draft of your letter in the forum, so members can make suggestions. Why not post here a copy of your hotel bill with personal details suitably redacted as well?

Unless the hotel bill and costs of food and drink were paid in cash, there should be debit or credit card entries as well.

And a record from your employer to your whereabouts on the night shift the day before.
As many have pointed out the irregularities with the ticket. When was it purchased as you did this on-line. Was it really collected at Mountfitchet.

The OP already has had a letter asking for their side of the story, and replied, which they have likely dismissed based on the evidence available to them. Remember they can check the ticket logs as well as the NLC on the ticket, and have access to their online booking accounts.

Was it really collected at Mountfitchet.
We know that it was not. This is not a fact which is in dispute; it is plain as day on the ticket. It was collected at MetroCentre in Gateshead.

Here we have two widely differing stories, one depending on a computer-generated ticket, the other the veracity of the OP and the two are mutually exclusive. We all know about the Post Office Horizon system and what happened there so it is up to the OP to prove that he could not have been in Gateshead at 15.09 as well as catching his flight to Europe. How to do this?

I would suggest:

1. An affidavit from the hotel manager stating the time that the OP checked out.
2. Credit/debit card details showing they were used in the Stansted area that afternoon.
2. Details of his flight, check-in times and proof that the OP was on that flight. I am not an expert in aviation paperwork so others may care to expand on this.

Of course, if the OP is not being entirely truthful with us...

Our family has in the dim and distant past parked up on the street in Stansted Mountfitchet and taken a train to Stanstead Airport

Indeed and that would be one plausible explanation. But the explanation the OP has given doesn't appear to match the available evidence.

I quite agree and I think the OP failed the attitude test both with the Gate line staff and this forum

The OP could always ask IRCAS what proof they have that they travelled from London
They could also helpfully invite IRCAS to examine the CCTV at SF
( Assuming we are hearing the whole story and I know it will no longer exist)
I am also perplexed why an RPI unless they are extremely stupid should on being shown a ticket that authorises travel claim it is no longer valid
I wonder what the RPI wrote about that in their statement if this is what happened
