Intent to prosecute letter received but paid fare, help!

Last night you were cross that you hadn't had a response. Now you're cross that you have had a response: there's no pleasing some people...

But joking aside, this is somewhat disappointing. Have they now got your first name right? I ask because that would show that they had received your letter.

Whether they have or not, essentially you need to send your letter again (don't bother about the bit about your first name if they have got that right now) spelling out that
- you didn't try to use a Railcard ticket
- instead, you tapped in for a journey that you could use contactless on
- you enclose proof of your payment
- in the circumstances you would be grateful if the railway could confirm that no further action will be taken.
Haha I guess I was hoping for a better response. They have got my first name right now and I’m gonna send everything through again but this is appalling that is was essentially an automated message that didn’t even look at my proof.

Found this which describes the journey better, if they don’t take this I’m sure it’s just an ai responding to letters.

Hi all, next letter is sent let’s hope my response is read this time, here is the letter.

In response to your previous letter regarding the railcard request, I would like to inform you that as I paid with my bank card, I do not need a railcard.

Below attached again is the proof that my journey on the 13th of may 2025 was paid in full at the adult non discounted rate.

I now hope that this matter can be resolved.

"paid with my bank card" could mean bought a ticket with it. I think you meant you tapped in with it, so you may want to clarify this.

You also need to quote their reference in the subject heading of the letter - it will let them tie your response up with your case.

Hello all another day another response, this one being very quick I might add. This response asks for proof that I paid with my card which i added into every letter I’ve sent and emailed it 3 times so it’s clear my letters have not been read lol, gonna upload my proof again and hope this is now over.

Hi all, thought I’d write an update after some time this morning. After my last post they decided to not respond and hope I wouldn’t complain about their stupidity. I did however start a complaint only receiving a response yesterday morning. That response stated that my complaint was invalid as they were just acting on terms listed in their conditions. I feel as if I was treated unfairly and the inspector had it out for me but no justice I guess, at least the fine was waived.

State owned for about 6 months now, so complaints can be directed at the DfT/your MP etc.
But as we all know the same old dross management will still be in situ, as when new 'private' owners appeared. New logo, new uniforms, same managers.

Do you have that in writing? Much aside from the complaint being waved away (I concur this is pretty shoddy of them), have they explicitly acknowledged in writing the matter is closed? You don't want a nasty surprise turning up when you thought it was dealt with!

I’d ask if you can take the complaint further and if not ask for a deadlock letter, then take it to the chocolate fire guard ombudsman.

I don’t actually have in writing that the matter has been dealt with, after sending in proof they never contacted again. You reckon that they’re just waiting to respond? Considering I complained about it and they disregarded it I’m sure the matter is over.

Given that the incident was on 13 May, it's most likely that the railway have dropped the matter in that if they want to prosecute they need to tell the court within six months of it happening, and those six months are now up. But you also need to allow a bit of time for the court to contact you, so give it maybe another month before completely relaxing.

What an appalling story. It looks as if the forum has been able to support the OP here in enduring a torrid experience. GTR seems to have excelled themselves in gross incompetence all round. I would endorse the recommendation to further that complaint and to take it to the Rail Ombudsman if no satisfaction is received from GTR.

I mean yeah it’s been over 6 months, the last time they replied regarding the intent to prosecute was 6 weeks or something so I doubt they’ll contact again.

I’m gonna contact the ombudsman today but I am pretty sure I require a deadlock letter I’ve been told, I’ll ask for that off of gtr.
