It's all it can be, nothing else there.
Will most likely be 810010 which should have left last week.

Why would that be a priority for EMR?

I'd have thought that with EMR facing a shortage of capacity, handing over shorter units first would be better, if they can get away with it.

Commercial contracts don't care about political priorities.

The thing about our lawmakers, is that they do make the laws. Whilst extreme, there are legal instruments for the government to use, should they wish.

There's a reason we have separation of powers, so governments can't just change to rules at will.

There are indeed, but only as an absolute last resort - not because EMR are short of several Meridians.

It's worth thinking about the consequences of what you are suggesting. If the government decided to unilaterally make a significant amendment to a fair and legal contract, made between two private companies in good faith then it would have massive consequences way beyond the railway industry. Effectively it would be legalised theft. It would effectively mean that no one could ever trust the government with a contract again. That in turn would push the cost of contracts with the government up significantly, as companies would need to price in the risk. Politically, a Labour government running roughshod over established company law would decimate their respect in the business community.

If the DfT wants to keep those trains for longer, they just need to negotiate with First to hire them back. It's been made clear on here that this is an available, if expensive option.

Lots of "Coming soon Aurora" messages have appeared on the platforms at Nottingham when I walked through this morning.

Here's a photo of one of the floor vinyls saying "coming soon", the "oo" in soon being a pair of headlights. EMR state that it's "Banksy style" artwork is designed to generate curiosity on the soon-to-enter-service Class 810s

The legal starting point of a 4th party failing to perform isn't going to stand up to much scrutiny in court especially if DfT, 810 ROSCO and EMR failed to use every instrument they had in their powers (which they haven't) let alone sufficiently early enough.
Presuming “which they haven’t” means haven’t used every instrument as opposed to haven’t failed to use every instrument, I think Abellio winning the franchise despite being the only qualified bidder rather set the tone!

This has got disaster written all over it. Stinks of panic over losing the Meridians to Lumo and being short of stock along with the usual political situation of "let's just get one unit into service to meet the latest dates we have promised."

My prediction is that the first unit in service will reach Derby on its ECS run before it fails and is returned to depot :lol:
