Traveling with expired railcard

I was travelling from Reading to Bournemouth on a CrossCountry service when tickets were being checked. I showed my ticket, which had been purchased with a 26–30 Railcard discount.

However, my Railcard had expired on 18 March 2025. I hadn’t renewed it because my regular weekday train journeys are during peak hours, when Railcards don’t apply, so I didn’t see the need.

The ticket officer handed me a slip to fill in my details and interviewed me. I answered all questions honestly and provided ID when asked. I also offered to purchase a new ticket on the spot, but she said I would receive a letter and should follow the instructions from there.

I’m currently in the UK on a post-study work visa and am employed here. I’m a little anxious about what the next steps might be and whether this could affect my career or future visa applications.

I explained to the officer that I wasn’t aware an expired Railcard still counts as a misuse if used for a discounted ticket, and that my everyday travel doesn’t benefit from Railcards, which is why I didn’t renew.

For context, I’ve had Railcards for the past two consecutive years and have never attempted to evade a fare. I recently bought a car, so I now travel by train only occasionally, usually on weekends.

Any guidance or insight into what to expect next would be greatly appreciated.

I explained to the officer that I wasn’t aware an expired Railcard still counts as a misuse if used for a discounted ticket, and that my everyday travel doesn’t benefit from Railcards, which is why I didn’t renew.

The chances are you will be able to resolve this by paying the undiscounted single fares for every journey you’ve made since the railcard expired, plus a three figure admin fee. You’ll need to cooperate with them and be honest. They will check your ticket purchase history.

But these paragraphs confuse me.

In the first you’re saying you knew the railcard had expired but had chosen not to renew it as you saw no benefit in doing so. That is to say you admitted what you did was deliberate and not an oversight.

In the second you seem to be saying that you didn’t realise it wasn’t allowed to use an expired railcard to obtain a discount. If that’s what you’re saying, frankly it’s preposterous.

That said, cooperate and you should get an out of court settlement

With regards to advice re visas, only authorised people are able to give that advice, and we are not an authorised body. If you are a foreign national, you should probably consult your embassy.

However, if you are cooperative and respond positively to any letter you receive from the train company or its agents, then it is extremely unlikely to go to Court; if you are offered the opportunity to pay a settlement fee to the rail company, then that will be the end of the matter, and your visa status would not be affected. Your best way forward is to come back here when you receive the letter from the rail company, and we can advise what to include in your response.

Post study visa - there’s a good chance that op can get advice from your uk university/ college overseas student office or student union about any impact if needed. But no need for that if it can be resolved out of court which with advice from here is quite likely.

What I meant is I knew it expired in march, but since my everyday travel does not take any railcard into account.

I assumed it would not be applied anytime either as the status was expired.

Since traveling on a train in a weekend is super rare for me, it was my assumption that just like the weekdays, there won’t be any discount applicable even on weekends now as my railcard is already expired.

Since traveling on a train in a weekend is super rare for me, it was my assumption that just like the weekdays, there won’t be any discount applicable even on weekends now as my railcard is already expired.
That's not how it works

If you select (or don't de-select) a railcard discount when you buy a ticket, the system will issue whatever ticket is allowed for that type of railcard. It doesn't know whether you have a valid one, an expired one, or neither.

Hello everyone, many thanks for the help earlier.

I have received a letter today in regards to my incident and it reads as follows

“
On Sunday 10th August 2025 a person giving the above name and address was questioned by a member of the Revenue Protection Team, employed by Cross Country Trains, in relation to a contravention of the Railway Regulations. Further investigations into this matter have been carried out by our fraud investigations team, including a Data Access Request under Schedule 1 Part 1 Paragraph 2 of the Data Protection Act 2018 and GDPR Article 6 (1) (d) to relevant ticketing retailers, to review your ticket purchasing history.


During our investigations, we have identified a number of Cross Country Trains journeys where the full fare has been avoided. Payment of £567.80 fares avoided plus £300.00 settlement towards our costs incurred is requested to avoid legal proceedings. Fares avoided are calculated as the anytime day single applicable for the dates of travel. Where a return ticket has been purchased, the fares avoided are calculated as two anytime day singles for the applicable dates of travel.


If you have any mitigation you wish to be considered, this can be sent to the above stated postal address, or to our email in 21 days of the date of this letter. If you have no mitigation, the
balance of £867.80 should be received within 21 days from the date of this letter by visiting our website. Please include our reference number on the reverse Cheques or postal orders made payable to the transport company cannot be accepted and will be returned accordingly.

Failure to respond or settle this matter by the date stated above, will result in legal proceedings taken against you. Fare evaders are prosecuted under the provisions of the Regulation of Railways Act 1889 and the Railway Byelaws made pursuant to the Transport Act 2000. In cases of ticket fraud, perpetrators are prosecuted under the Fraud Act 2006.”

I have removed the necessary details like payment details etc and uploaded the content of the letter.

The company handling the case is ITAL.

I believe paying the amount and settling the case is the best option to avoid further complications.
I will kindly wait for any advice and guidance before proceeding.

If they have mis-identified any of the journeys, then by all means query it.

Otherwise I would agree with your decision to pay the full amount, though I find the admin charge excessive. You are unlikely to get anywhere with challenging the use of Anytime Single fares.

Thank you again for all the guidance and support.

I have completed the payment of the full amount of £867.80 as mentioned in the letter from XC within 10 days of date of the letter.

I have received a copy of payment instantly.

Will they be issuing a letter confirming that the case has been settled and closed?

Not sure. But it’s not unreasonable for you to ask for written confirmation of that.

Keep copies of everything and keep that all long term ie over a year.

Thank you, I think I’ll give it a day or two and check with them and request a written confirmation.

All of the communication received has been electronically so far, the email said a copy of the same email attachment would follow by post too, it’s been more than 10 days and I haven’t had anything in the post.

I will definitely be preserving everything associated with it.
