Valid ticket but I got caught following someone behind barrier

Hi guys, would really appreciate any advice on my predicament with TFL!

I was trying to travel from Finsbury Park to Brixton, but there was an event happening in the park and there was a queue to get into the station. The staff closed access to the Underground line. I tapped in with my Apple Pay and had to get a National Rail train to King’s Cross, then had to get the Victoria line from there.

However because of the amount of people travelling from the event, the exit barriers at the National Rail part of King’s Cross were open when we arrived and I didn’t (regretfully) tap out. When I got to the London Underground part of the station the barriers were closed as usual. I asked the security man standing behind the barriers (who wasn’t wearing London Underground uniform) what I should do, as I hadn’t tapped out and it was very busy back at the National Rail part of the station and would have been hard to reach over and tap in from the other side of the barrier. He just kind of fobbed me off and pointed back where I came from, not having really answered my query.

After wondering around for a minute or 2 I still didn’t know what to do so my thinking was, rightly or wrongly, that because I’m still tapped in I can just follow someone else in through the barrier, which I did. The same security man came over and demanded my details and I gave them to him. I then went on my way, got to Brixton and tapped out there, so I have paid for my journey.

I got the letter from the Investigations Appeals and Prosecutions Team and have to reply to them and accept or deny committing an offence. Have I committed an offence even though I had a valid ticket?

If anyone has any advice on what I should do I’d be extremely grateful, thanks!

You breached byelaw 9 (2) so, yes, you have committed an offence.
Not sure whether the same byelaws apply to TFL, but for clarity, byelaw 9.2 says:-

where the entrance to or exit from any platform or station is via a manned or an automatic ticket barrier no person shall enter or leave the station, except with permission from an authorised person, without passing through the barrier in the correct manner

The employee should have explained the system to you - the correct thing to do was to tap in as normal. It didn't matter that you hadn't touched out for the first segment of journey. Tapping in on the Underground would have filled the gap.

Following someone through is an offence in itself, but if you were tapped in and the journey has been paid for and you can show there was no loss of revenue, it's a situation where you might be able to persuade TfL to resolve the matter by just giving you a warning.

unless I am misunderstanding you tapped in at Finsbury Park, passed through Kings Cross (walking though open barrier, without tapping, then entered through different barrier (but followed someone), then tapped out later.

It is possible an auto-complete has already done whole journey (and would assume direct on Victoria line), and explaining this (with just a transit through the gates) might get you off, or a warning to tap.

Technically you didn't use the gates in proper manner, but you also walked through an open gate without tapping (getting you outside gate line) which could also be seen as not in correct manner. It's sort of two wrongs doesn't make it right. Not sure how they will see an exit and reentry at same station in incorrect manner. It's kind of thing that happens in alerts that are then cleared and everyone resumes journey.
