If you just put you're a student the court will assume a low income, if you tell them you're working they could fine you more (I'm aware that you are allowed to work 20 hours a week - it doesn't mean that you do does it?) - can you prove you're enrolled on a course at university?

The OP needs to be honest and fill out the form truthfully. There’s no other advice we can reasonably give. “Hmm if they find you’re working they might fine you more” - yes, they will, because the fine is based on one’s income. Failing to declare that to the magistrates’ court obviously isn’t clever. Or legal. And is worse than the original offence.

It seems the OP is employed, so must declare that, and what they are earning.

As I am due to leave the UK this month and never return back, it would be challenging for me to address this matter at a later date.

Have I missed something? Why are you still in the country and now working?

Much of the previous advice has been based on your leaving in February. Are you going or not?

@vijay001 This is what I would suggest in terms of amendments. When you have it ready you can send it to the railway company prosecution department. I suggest that you e-mail AND that you send it printed off copy via tracked postage sent from any post office shop.

I think you also need to be clear when you are leaving the UK. If you have not complied with a Home Office / UK Visa & Immigration service letter / request to leave the UK then I suspect that is a more serious problem to get yourself into, but that is another matter and one I can not offer any advice about

I hope what is below is clear. Make sure you enclose the things mentioned, (ie your letter telling you you must leave UK due to expired visa) even if you have sent them before.

I’m afraid I do not understand what you are asking here.

If you want to draft a mitigation statement to send to the court for people to check here, you can do so.

If you have already done that please state the number of the post it is in in this long thread so people here can easily see what you are referring to.

I don’t know what mitigation statements are most effective but hopefully people here can look over that section of post #179

regarding your court mitigation statement

Some basic advice on court mitigation statements is here if you want to look over it:

Okkk fine I send the pages which is important. And MC 100 form I want to change minor mistakes. Instead of 10 I put 20 in outgoings . But I don't have any evidence with this. Should I change before sending back.?

Yes. Change it so it’s accurate. The form makes it very clear you should not knowingly declare wrong info. You do not need to supply evidence when you send the form back I don’t think.

Print off a new blank form and fill it in without mistakes.

Hi guys hope everyone is fine and doing well. I already mentioned I have case 1 which and I appealed against address issue and court hearing date on march 19 after that I didn't receive any outcome of case. So yesterday I messaged to court about my outcome. The court pre team send email States as . Can someone help I am little confused

The case was heard on the 19/03/2025 and the result is still at the moment being processed. You should receive correspondence shortly. However, we are able to confirm that the application was granted and your Guilty Plea was taken into consideration. Costs are as follows:



Fine: £40.00

Compensation: £4.80

Victim Surcharge: £16:00

Costs: £67:00

Because it has only just happened, the court has not yet officially written this to you yet, but will do so shortly. So you need to have the £127.80 available for that official request, you are advised not to pay it until the letter comes in, otherwise it will confuse matters. You have a criminal record, it will be considered "spent" on 19 March 2026, so in most cases you no longer need to tell employers and education providers (etc) of this criminal record from next year onwards. I would guess it may take another week or two until you get the official letter.

You have a criminal record for all time, but it will become spent after a year. You should consult the charity Unlock to find out exactly what this means, because it is important and there are some obligations you have as well as some protections when it comes to declaring or not declaring convictions in some circumstances.

It will comes under local DBs check .
What do you mean by “local DBS”?

As I said, from 19 March 2026 it is "spent", so not more than 1 year. It won't show up under DBS usually, but if your employer asks about it, or it is in your contract of employment, then lying about your record is more serious than the criminal record itself. As you are leaving the country I can't see why this matters. The previous letter indicates what the rail company wanted by way of costs but here it says £67, not £74 - this may just be what the court will allow in your case. However if you wait for the formal letter from the courts, this will give the definite and correct amount.
