Please I need help, I was sent a notice of intended prosecution which I was given 14 days to resolve.

I actually travelled that day without knowing the essence of using a railcard. I did explain to the inspector but he said that they will send a warning But instead I received an intended prosecution

Could you elaborate on what happened? Do you have a railcard? Which railcard discount did you try to use? Which train company is involved here? Which journey were you making and what tickets were you using?

@yuu. Welcome to the forum. Can you upload a copy of the letter you've received, ensuring that you obscure or otherwise cover up your name, address and case reference number. Are you dealing with TfL or some train operating company?

And is the essence of the situation that you travelled using a railcard discounted ticket, but don't actually hold an accompanying, in date, valid railcard? Have you done this before maybe, previous to the time you got stopped?

Also, as @AlterEgo has also just asked, what was the problem journey in question (to/from?) and when was it?

Following you being spoken to; the Economic Crime & Fraud Unit submitted a data access request Under Schedule 2 Part

1 Paragraph 2 of the Data Protection Act 2018 and GDPR Article 6 (1) (d), to various rail ticket retailers, which has revealed that you may have avoided the correct rail fare on other occasions.

If you have a valid railcard but were unable to produce it to the rail official on the day in question, please email a copy of any railcards you hold or previously held for us to review.

The purpose of this letter is to advise you of the report and of any action that may follow from it, and to provide you with the opportunity to inform us of any mitigation that you may wish to be considered. This can be sent to the address shown above, or via email at Fraud@chilternrailways.co.uk

The report of this incident indicates that in the absence of a satisfactory explanation, evidence does exist to warrant a prosecution in accordance with the current legislation. These considerations may include whether any charge should allege an offence against Railway Byelaws (2005), or the Regulation of Railways Act 1889.

You are therefore advised to seek out independent legal advice from a Solicitor trained in criminal law and who is registered with the Law Society. It would also be an advantage if they have knowledge of rail fare law, as this is a specialised area.

The company considers this a serious matter, and if we do not hear from you within 14 days of the date of this letter, this matter will be passed to our Prosecuting Authority with a view to obtaining a Summons to a Magistrates' Court hearing, this may be issued without further reference to you.

recently bought my railcard, the inspector told me that he was going to send a letter on how I would pay for the railcard, rather they sent me notice of intended prosecution
I bought a train ticket using the London railway app, entered the chiltern railway, the first inspector checked and nothing happened, before I got to my destination, another inspector checked and asked for my railcard, I was clueless and I explained to him I don’t hv a railcard and I didn’t know I needed to get one to travel, then he said they would send me a warning

That doesn't answer the questions:

Which railcard discount did you try to use?
Which journey were you making and what tickets were you using?
Also, which railcard have you now bought?

Could you upload any paperwork you have received with your name removed please, so we can see what we are dealing with here.
