There are twenty-eight TfL cases listed on at Lavender Hill Magistrates Court today so there could be quite a wait or even cases getting put back to another day depending how many people show up.

I just had mine, they gave me a fine. I thought it would be a bit different it took less than 5 mins.
They just asked me if I was guilty and how I want to pay the fine.
I was a bit upset they didn’t let me state my mitigating circumstances nor did they mention it so I’m not sure if they even saw it. I didn’t get the chance to say what I wanted to.

They said I have a conviction which will be unspent 1 year from the date of the fine given. What does unspent mean? What’s the difference between spent and unspent? Do you have to disclose unspent after a year in this case?

Does anyone have any advice on what I can do with the situation with my university? I can’t seem to find contacts for DBS if anyone can help with that too?

Thanks for all your help

You'll get a letter in the post confirming this.

That can happen when they have 28 cases to get through in 5 or 6 hours, though it's perhaps poor form. However, if your fine was £40, they don't usually go under that amount anyway.

It will be spent 1 year from today. After that you won't need to declare it for most purposes.

Already covered in the thread.

Already covered numerous times in the thread.
I can’t seem to find contacts for DBS if anyone can help with that too?
DBS contact details are on their website which is www.gov.uk/dbs

I have access to magistrates court listings.

It's unlikely any mitigation would have taken it any lower, for what it's worth.

You now know exactly where you stand i.e. you have been convicted and fined. So now contact the university and see what they have to say.

I know that you're probably shaken up after being in court, but try to get hold of the university on or before Wednesday: A level results come out on Thursday and so from Thursday the university will be very busy with clearing.

I'd also say that this week could be a good time for the university to change their mind: it's not widely known (but neither is it secret) but they will have had the A level results since Saturday* and may have found that they have more places on your course than they thought. So they might be more flexible about who they can take than they were before.

Get in touch with them - the worst that can happen is that they say 'no'.

* For the benefit of anyone stumbling on this thread: no, they're not allowed to tell anyone what their results are. Candidates still have to wait for Thursday.

I'd wager only 7 people show up.

You might find help, or at least advice about criminal records checks and healthcare careers with a criminal record, from the charity Unlock: https://unlock.org.uk/
Will take a look thanks

I called NACRO as advised by the court they said the issue with TfL is it depends on the court. Some put it down as non recordable some don’t it’s just down to luck. Apparently also when I had a chat with the prosecutor who ran through why your there etc he said I was actually sent to the wrong court because they suspected I was being accused and convicted of all 112 journeys but in reality I was only convicted of 1 journey. I hope this doesn’t impact me negatively

It shouldn't make any difference. The actual conviction will be the same, but it would normally have been dealt with by the Single Justice Procedure Notice route.

Telling your potential Uni the exact details of the offence and the fine ("£40 plus costs etc") as stated on the documentation might persuade them that you are not a risk.

How would I answer this:
Do you have any convictions, cautions, reprimands or final warnings which are not ‘protected’ as defined by the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (as amended)?

would it be yes or no

I’m not sure because he said he needed to have a word with staff about it.

also just out of curiosity so the other people who were there for numerous occasions of misuse I’m assuming would that not be dealt with SJPN.

can I confirm even though I went to court this is classed as SJPN right?

The correct answer to this question for the next year is Yes.

As you were summonsed to court, the case was not dealt with via SJPN.

You misunderstand. The SJPN is an administrative procedure about how a particular offence is dealt with.

The relevant information is that on (date) you were found guilty of (exact offence) and fined (amount*).

*I don't think you are obliged to tell anyone, but the amount is an indication of how seriously the offence was believed to be.

If you answer yes to the Uni's question, is there an opportunity to give the detail?
(I am fairly sure you have asked this at least once before BTW.)

Yes there is but I’m still thinking of what to say.
and I don’t think I have asked it as I only went to court today

But I don’t see how that’s my fault. I stated throughout my plea that I was guilty and I even contacted contact crime Who act on behalf of the court who told me more than once that it wasn’t a case of me pleading guilty then making it seem like I wasn’t when I gave to circumstance.

the court asked me to come to hear my mitigating circumstances in detail most likely the part about my job and wages etc because that’s all that was asked in court from me .

they asked me to come to court, TfL’s prosecutor mentioned I was the only one with different paperwork, didn’t have any of the other sheets to fill in and that I had been filed down to being sent to the wrong court, I had one sheet of paper whilst others had 4-5 and had to sign things each time they went to see the prosecutor.

With respect, this is entirely irrelevant.

Also, nobody is going to ask you whether you were prosecuted via SJP or summons.

Ok I assumed sjp was more lower scale, my mistake
No, SJPN or summons, same offence - just for whatever reason they used a summons this time, perhaps in error. Makes no difference to the outcome.

If you read back through the thread it did start out with an SJPN, it was discussed for some days, then for some reason the magistrates appear to have called the case into normal court.

I think the answer is “Yes” even after the conviction is spent, as the concept of protected conviction is narrower, applying to convictions which are very old (and not related to regulated professions/activities). The Order referred to in the question disapplies the concept of spent convictions where the job, role, or training is linked to sensitive activities, such as healthcare. I think the answer is “Yes” for the next 11 years.

These are questions to ask the university, a trade union related to the occupation if you’ve joined one, or charities such as Unlock and Nacro. Having to disclose is not a legal bar to being trained or employed in a particular profession or occupation, but is something employers and training providers have a right to know about.

Ah yes indeed. I was looking for the word “filtered” which is the usual term for very old minor convictions which drop off standard/enhanced DBS checks but “protected” is another term used for the same thing.

Well. Now that we have an outcome I suppose we should probably wrap this one up. 474 posts, blimey!

Thanks everyone. I would say that a lot of effort has been put in here. ;)
