But doesnt this policy effectively create an inconsistency when compared with the penalty fares regime?

PF regime Penalty Fare of £100 (£50 early payment discount) and full single fare (no railcard discount) but no administration fee.

GTR regime No Penalty Imposed, fare difference (fare due - fare paid) ((discounts apply)) charged and an administration fee.

Whilst in practical terms the PF (£100/£50 component) could be seen as an admin fee, in legal terms it is not so.

It begs the question under what circumstances does a revenue protection inspector issue (1) an unpaid fares notice (2) a penalty fare (3) Ticket irregularity Report for further investigation.

I suppose the turning point will be if the RPI believes there is a probability of other occasions of an invalid or incorrect ticket being proffered for travel and therefore it needs further investigation.
That is probably best discussed in a thread of its own.

Update: after my last reply to GTR informing them that I’ve itemized everything and happy to share my spreadsheet if it would help, I received a reply back the following day with a settlement figure and their own spreadsheet which itemized all the short fares. Our figures were very similar (theirs was around £100 more) so I agreed to the payment which was just over £2.2k. That included £300 for their admin fees.

They used the difference of what I had already paid and what I should have paid to calculate the difference.

To anyone in a similar position, I recommend in the first instance that you deal with GTR directly without a solicitor. Just be genuine, honest and don’t try to hide anything from them.

Judging by thus, and a few other threads, this seems to be GTR's normal practice where the sum involved is substantial. It's useful to know, so thanks.
