Hi everyone.

I was recently stopped at Marylebone after using a ticket to Wembley. (I was heading to Haddenham & Thame Parkway).

I had purchased a day return the previous day but missed the last train so bought a ticket the following day to Wembley to get through the barriers.

It was brought to my attention during this that my Railcard had also expired recently.

I received a letter from TIL explaining the events. They also say in the letter there were other occasions where I had used a different Railcard than the one I have. (See attachments).

I have replied to the initial letter which they have replied to with another letter saying an application for a court summons may now be made.

Please could you all advise. I have attached all correspondence.

Thanks in advance

It’s often necessary to send two letters to TIL to get them to offer an out of court settlement.

I send them a reply, basically re-writing what you said in your original reply and see what they say.

In your second response a bit more emphasis on acknowledgement of wrongdoing and apology, and a little less explanation of what they can prosecute you for, would probably be a good idea. With a very clear request to settle the matter without court action.

Also suggest you check the wording carefully (you have used ensure and insure) for errors that spell checker wont pick up.

Suggest you change the phrase "I would be willing to pay any outstanding fares" to "I am willing to pay......" as the second phrasing is more direct and not conditional.

Or better, something like "I would very much appreciate the opportunity to pay...".

Your second reply could perhaps more clearly distinguish between the first occasion (short fare and expired railcard) and the second

("Checking back, there is one further occasion when I incorrectly applied a Senior discount:...")

If there are no further instances you are aware of, you could then say so - otherwise stop there!
