Great debate.

I think I’ll reach out to my most used TOC and get clarification from them.
Does anyone have a contact email at Greater Anglia which would be most appropriate?

So how does this thinking work on a return portion of an open return ticket? Should you never claim delay repay for that leg of your journey as you have 1 calendar month to complete the journey and obviously no contract made from a time stamp point of view?
Open return tickets are in the slow process of being abolished - abuse of delay repay is a factor in this because of the open ended liabilities that Delay Repay brings, with no requirement to prove one’s actual travel. It’s basically an honesty system.

I really don’t recommend doing this for your own sake, especially if it’s Greater Anglia.

More nonsense. You really have no idea what you’re talking about, do you.

In other words, your original assertions were wrong in law.

And even this latest attempt misrepresents the legal position.
Well I am sure that any affected forum members will be more than happy to get in touch with you, when they rely on your advice in future, when making these claims.

I've presented reasonable, coherent arguements and given my opinion, just like everyone else on this forum, and my parting words on this is that this is exceptionally unwise and likely to lead down a problematic road.

I am not sure why this forum is so against debate - especially when it's reasonable and polite, no harm in pointing out deficiencies in both sides. This is simply an area that it appears there are opposing but equally valid perspectives - and it would be a good test case to progress to a civil or criminal court, as I think there are decent cases for both sides.

In the meantime, changing the conditions to remove any doubt here seems a more pragmatic way forward! Perhaps that will happen

contactcentre@greateranglia.co.uk

However, if you don't like their response, and you then submit DR claims on that basis knowing their initial response, I'm sure you know what is likely to happen next.....

Surely gaining clarity on this situation from the TOC is the way to go. Otherwise as Tazi says, I could end up in court unless I buy the ticket before the cancelled train is due to depart

Like I said, I wouldn't recommend alerting Greater Anglia to the fact you've been doing this. They will inevitably investigate all your previous claims, and this will only cause you difficulty.

Well I for one am happy to rely on advice from @tspaul26 because various senior members have met him, we know what he does, and he can be contacted by private conversation if necessary. You on the other hand tick none of those boxes, hence me needing to post this here.

So a forum member is providing legal advice and discussion on legal arguements (or even just assistance) to those facing potential prosecution/investigation by private message? Interesting.

S.12 Legal Services Act 2007

In this Act “legal activity” means—
(a).....
(b)any other activity which consists of one or both of the following—
(i)the provision of legal advice or assistance in connection with the application of the law or with any form of resolution of legal disputes;
(ii)...

Wait until you find out what he does for a living and why he's so confident in telling you you're wrong on matters of law. It's amazing you haven't figured it out yet.

That's not what I said. I said if it was desired, they could be contacted by private message.

For your next task, read section 13 (offence of carrying on reserved legal activity) then explain the difference between legal activity and reserved legal activity ;)

Officially, you're not allowed to be paid more in total delay repay compensation than the cost of the ticket.

In practice, the train companies are often unaware of what other companies have paid out so yo can end up being paid more than you're officially entitled to.
In practice is what has happened. Both claims have been processed. Surprisingly CrossCountry have awarded 100% of the cost of the return ticket even though my outward delay was under 120 minutes. SWR also awarded 100% of the cost of the return ticket.

Double bubble. Kerching!
