Hello , I was catching last week using my daughter zip oyster. The man was there and when I touch he stop me straight away.I used many times since last 3 weeks but before summer I bought a weekly oyster and I can send my bank history and they can check.
I was polite and gave my details he took the zip oyster. Today I receve this letter, I want plea guilt and apologise any chance to not go to court? I can pay the penalty but I would like avoid criminal records because I don’t have any at the moment.
I really don’t want do anymore, I don’t have any penalties from buses or tube before, thank
You .

Welcome to the forum.

TfL (the organisation that has written to you) may be prepared to settle out of court (that is, they will let you pay for the fares that you should have paid, and also an admin fee on top of that: this would mean that they do not take you to court) but it's more normal for them to prosecute (they take you to court: if you plead guilty or are found guilty then you have to pay a fine plus costs plus court costs plus the fares you should have paid). So you might be lucky and avoid a criminal record, or you might not be able to.

As TfL have asked you for your side of the story, tell them what you have told us. They will also want to know that you won't be fare dodging in future: as you used to buy a weekly Oyster in the past, it seems to me it would be good to start buying one again and tell TfL this: also send TfL a copy of the receipt for the new weekly Oyster to prove that you are telling the truth.

TfL have only asked you about this one incident so you may decide that's all you need to tell them about. But don't forget that they do check up on passengers so they may know that you have been using your daughter's Zip for three weeks. That means it's important not to lie: don't write anything like 'This is the only time I have used my daughter's Zip Oyster' as they may well find out that this isn't true - at which point they won't believe anything else that you tell them and it will be even more likely that you have to go to court.

Thank you so much to reply. I would like ask if I can have back and how the zip oyster.
Section 10 of the Zip Oyster conditions says this:

"5. If we are aware of fraudulent activity relating to the usage of the 11-15 Zip Oyster photocard by you or your child, the photocard will be stopped and your child may not be allowed another Zip Oyster photocard."

Sorry, I've only just seen this.
If you are prosecuted under the TfLByelaws (called House Rues in some languages, don't know if that helps!) then you don't get a criminal record.
TfL often do this, but there are more serious offences they could charge you with - sorry, you'll have to wait and see what they say.
Either way, a conviction may still show up on an Enhanced DBS Check (if that doesn't mean anything, you needn't worry!) but it isn't too much to worry about.
