Part of me would be tempted to point out that firstly that nowhere is it stated that you have to seek out staff onboard if you've not had an opportunity to pay. Could you imagine 50 people trying to surround the guard who's trying to dispatch the train!

And secondly that the National Rail Conditions of Carriage hasn't existed for 4? years now.

I’d personally be inclined to suggest that some arguments are worth having, but this one isn’t one of them. My suggestion would be to breathe a sigh of relief and move on.

I think even my level of pedantic-ness doesn’t stretch to arguing the minutes once I’ve been acquitted of it. If they used it as an argument for a prosecution, absolutely though.

Agreed. If you challenge this, they might change their minds and proceed to prosecute instead.

A good result considering how difficult TIL has been in the past in wanting money. It will be interesting to know how long they plan to keep hold of your personal details, under the data retention principles of the GDPR.

I’m interested in the citation of the Corbyn case in the reply. Thankfully an argument will be on the forum and wholly academic, but I (a non lawyer) am interested to hear opinions on whether any fare could possibly be due as they indeed assert.

It sounds like it's just a part of the standard 'bumph' they include in their letters to scare people into compliance.

Corbyn was a RoRA s5(3)(a) case, the first condition of which is that the passenger travels without having previously paid his fare. So quite evidently, given that @_toommm_ had paid for their ticket online, it is a red herring as no prosecution could be brought under s5(3)(a) regardless of intent.

Of course there is the more salient issue of a potential Byelaw 18 offence, where the permission (or otherwise) given by the members of staff would be the relevant issue.

This is an interesting thread - I've always wondered about these strict liability offences: If say, you have a valid ticket when you start you journey but then you lose it, it seems you have committed a criminal offence. This is harsh but fair enough, some might say, its every passengers'...

I appreciate your clarification and correct use of apostrophe to indicate the missing letter in the contraction, as opposed to the more colloquial “tis” with its distinct lack of apostrophe.
