Hi guys, know its been a while but I want to jump back in and let you know the update/s which occurred. I know a lot of people tend not to come back but I feel that the advice and service which was offered on this forum was invaluable and I hope to share some perspective on the matter in case someone else is going through a similar scenario.

1) After my submission of "Case of Events" (in an earlier post), I received an email from the prosecutor informing they have received my letter and my case will be reviewed further over the next few days. After reviewing, they will be writing to me to confirm their decision.

2) Shortly after this email ((1 -2 weeks) I received in post TFL's review on my situation and their decision. Although there was sufficient evidence available to continue their prosecution, they considered my mitigating circumstances and have decided that a Formal Warning will be suitable for the situation. It then led on by asking me to pay a disclosed amount within 28 days otherwise legal action will continue. There are a list of points listed printed on the back of the letter which states the conditions of withdrawal.

The payment process was simple and very quick over the phone. It was an automated service between the TFL staff and my phone. Only information exchanged was case number and they were able to pull up all the information needed on their side. After payment your receipt will be sent over to your phone and to your email provided in your case number (if applicable).

And that's all in my case.

I just want to thank everyone on this forum for their insight and advice - not only for myself but for all the other people facing their cases. You guys are really wonders and totally need more appreciations.

My advice to everyone out there is please do respect all your transportation guidelines. I have learnt and fully understand that my actions were extremely bad and still am facing some of the consequences from it. Lesson learnt for the long run. I want to say that I was very fortunate in my case.

TLDR: My case ended in a Formal Warning being issued upon full payment of a disclosed amount.

If you guys do have any questions regarding my case I'll be happy to answer anything which is deemed reasonable.

Thanks @CoconutKinder for setting out in detail what happened with your TfL case - I do think this will be helpful to others to read. Good luck for the future to you.

Thanks for letting us know. From what we've previously seen, TfL very rarely settle out of court so this is a really good result.

Do you feel able to let us know how much the settlement was? It would help us to give good advice when other people come along with similar problems. Of course, you don't have to tell us, particularly if TfL have asked you not to say.

Really appreciate your time @WesternLancer and thank you for the kind words.

I do not feel comfortable to give details of the exact amount but it was a sizeable amount (above £300). It was less than what a solicitor would charge (average quotes was £700-900) which does not include if you want them to draft a letter for you (quote was around ~£150).

Hope it helps.

Hi guys,

Recently stumbled upon this forum and read a few threads about similar events to mine but just wondering would you be able to shed some light on this matter.

I have recently received in the post a letter requesting for my events regarding the use of my mother's freedom pass and whether I deny or accept committing an offence. The pass was detained at Piccadilly Circus where the officer took my details and informed me that I would be receiving a letter in the next coming days. I asked the officer to let me tap in on my contactless card so I can continue on with my journey.

Background is that I have used the freedom pass on quite a few occasions (not sure how many) over the course of 3 months to travel to and back from work and some leisure trips around London. Careless and stupid and I regret doing this but it has happened. Definitely a stern wake up call that no one should be doing this.

I of course will not be doing this no longer and swore to my self to just be respectful of our country's transportation as it's actually very good and helpful.

And now I am wondering what the best course of response is. I have 10 days for a response. I have contacted a few solicitors already and all have given me general advice without a paid consultation. I would love this to be settled outside of court but from what I am reading, TFL usually, if not ever, settles it this way. I in no way want a criminal record and will pay suitable fees which will reimburse the parties that are involved as I know it is all my doing causing this.

Any help would be greatly appreciated and if you do need any additional information I would be happy to supply if it helps.
Hi
Did you only send one letter? The one you posted earlier?

Hi there @Zabina25

It was just the letter drafted in post #26 with some tweaks (I suspected a few members may have tried to copy and paste my letter which is unfortunate but the main body of the letter remained the same) that was sent to TFL.

Thank you for the detailed report.

Would it be OK for you to upload an image of the conditions they set for the settlement, in case there's something for other people to learn from?

On the amount, maybe people would be interested in a general idea if that suits you better.

Did you actually mean an undisclosed amount? I am assuming that your agreement prevents you from saying more than you have already.

The amount was specifically mentioned on my letter (so this will be disclosed?) but I am not comfortable quoting the exact amount. It was several hundreds of pounds but less than what several solicitors quoted me for taking my case on.

Whilst on my agreement it was not stated that I can not share information, I do believe that quoting the full letter and its content may lead to other sources using the information against me hence why I am choosing to withhold certain information.

I however have no problems answering and sharing any information which I deem relatable and helpful to everyone. I hope this is of mutual understanding.

Whilst I can not upload a full image of withdrawal conditions, I am happy to list a brief summary/ points of my letter. Of course I want to raise awareness to how serious these cases are and strongly advise against committing such acts.

I will do so with an edited post later on. Hope it will help.

You had an extremely good result. Please, whatever you do, learn from what happened and do not repeat your actions. If you do it is unlikely to end well for you.

I 100% agree @Wolfie and from the date of the incident I have not repeated said actions and will continue to do so. It was a detrimental lesson, one that has affected me in more ways than one, but I have surely learnt from it.

Really glad your case went so well!
Can I ask how long in total you waited for the response? Did TfL contact you to tell you they had your case information? Did you do anything else in the meantime to help the case?

If you have a similar issue, it’s best to make your own thread and then we can advise and help :)

You’re better off starting your own thread. Your situation is likely to be different from this OP’s, so their letter may not be suitable for you to use, and you’re also likely to attract more replies by creating a new thread.
