Hi everyone, Im new to this but Ive found it very interesting and from reading previous posts, hints and tips I do hope someone can give me some advice!

A relative in Scotland bought some tickets from EC online for me and my children to travel up this Friday. The option was selected to have the tickets posted special delivery at a cost of £5.
Ive read the terms and this states that tickets purchased before 1600 hours will be delivered by 1300 the next working day, However the tickets were purchased approx 1900 hours monday evening so i was expecting them to arrive today, however they havent!
My normal post came so i know the posties are back to work but no special delivery,I was informed by my postie that special delivery is done by the van.

As it wasnt me that purchased the tickets, i dont hold the card that paid for the tickets, and my worry now is, If the tickets dont arrive tomorrow, What do I do?? Its going to be stressful as it is travelling with 2 under 5's, i could be doing without any more added stress!!!

As I understand it, in the tickets by post scenario, the purchaser appoints the seller to act as their agent, thus relieving the seller of the normal responsibility for the tickets, so it becomes the responsibility of the purchaser to do the chasing up.

The best thing to do would be to see what happens tomorrow morning as the Post Ofice is dealing with a very large backlog. In the meantime you need to get the person who bought them to contact the seller to establish what the tracking number of the package is. Special delivery items are tracked constantly and a number is always provided to the person who actually posts the item. The seller will only pass on that detail to the purchaser, if they did not already do so at the time of purchase.

Having gotten the tracking number you can see where the package is, together with a likely time for delivery.

Making a claim for a refund of the cost might be interesting bearing in mind the fact that the service was not delivered, then again bad weather may well be an exclusion clause.

Bear in mind it was a bank holiday, as was Monday, meaning that like on Sundays, if you place an order on it, it won't come the next day.

From the sale of goods act;
the goods remain at the seller’s risk until they are delivered to the consumer
(There is some debate about whether railway tickets are 'goods' - but there is precedent that says they are, at least in some circumstances).

The tickets wouldn't have been sent yesterday as they are posted from England, and it was a bank holiday.

If they don't arrive tomorrow, then you will need to telephone them, and arrangements can be made for you to collect the tickets at the station.

I organised a similar thing through NXEC a while ago and paid for the Special Delivery. Tickets arrived next day but STD first class post :(
Eventually got my money back though.....

Thanks, I'll get in touch with who bought them and give them ur advice to get the tracking Number, They did give me a reservation Number but ive been on to EC website but i cant do nothing with just that.
I recieved a letter in the post that was dated the 24th dec, which tells me presumably it was written and posted on xmas eve, and its come in todays post, so if there is a problem i wont let them use the weather as an excuse, So thanks for that advance warning,:D

Didn't Royal Mail lift the guarantee on special delivery at one point? Is this still in place?

I have a letter after my house number so sometimes mistakenly(postmans fault of course)my mail goes elsewhere. If the tickets arrive special del i will be delighted, i will be delighted anyway if they just arrive std 1st class,
But the point being an extra £5 was paid for special delivery, ok so i shouldnt of expected them to arrive nxt day being bank holiday but i should be able to expect the tickets arrive in the rightful owners hands, having the problem i have with that letter theres every chance if its in with std mail it could go elsewhere, and £5 is better in my pocket than theirs. Lets see what tomorrow Brings...........Thanks for advice

monday and tuesday were both bank holidays so as above have said they will be posted out the next working day after which was today, Wednesday, so therefore you should receive them the next day after today.

Most ticket selling sites clearly state in the terms and conditions that they accept no responsibility and that they act on the understanding that they are YOUR agents. If you do not accept this then there can be no Contract in Law.

A Company and a Seller can agree to trade upon whatever terms they wish as long as it is willingly.

If they willingly wish to exempt part of the Sale of Goods Act knowingly then they are free to do so.

Without wishing to go too far off-topic, and spend too long researching it in detail, this is broadly incorrect when dealing with 'consumers'.

The unfair contract terms act, for one, specifies that consumers rights cannot be excluded or restricted by contract terms and conditions.

From the Royal Mail website:

Re-instatement of the Special Delivery™ guarantee

The improved conditions and recovery of services across the country means we are now able to restore the guarantee for Special Delivery™ items posted from today, Wednesday 29th December. We are restoring the guarantee, which was withdrawn on 1st December, as we are confident we can now meet the service promise to customers.

So I would say they are likely to turn up tomorrow ( Thursday ). But quite frankly the EC website people must have known that the Special Delivery guarantee had been suspended and should have made that clear on their website.

We had some tickets due for (normal) postage booked through the East Coast website for a journey in August. When we phoned them up to say they hadn't arrived, they told us to go to the Travel Centre at Glasgow (our origin) and they'd faxed them a form to reissue the tickets.

Exactly they shouldve made this clear if not on the webpage itself at least at the check out when you select the option...
Anyway Good news the panic is over i got a lovely wake up call at 7.30 this morning from the postie knocking at my door, so my tickets have arrived. Thanks to everyone on here for your hints tips and advice....

Bobsgirl26 - glad you got good news...and tickets!
Plus you got, from the forum, folks to at least talk to and get advice.
It's nice to not feel alone in situations like this.
