My position

I used my freedom pass to open the gates at Victoria station London. Then I had a ticket from burgess park to Brighton. Got caught trying to exit the barriers at Brighton. They asked me if I had done this before. I truly can’t remember but said no. They warned me that I will be checked. If it comes to
It I’m pleading guilty. But how will this affect me? I’ve no criminal record or ever been charged before. I truly regret it now. What’s next?

1. I would be very surprised if they could check your Freedom Pass history so you need probably only think about the recent incident.
2. I presume you had contact details taken, in which case Southern or their agents will be in touch asking for your version of events.
3. Assuming you have no "history" you may be able to reach an out of court settlement; meanwhile, there is nothing to do but wait for a letter, which may be some time arriving.
4. A criminal record, if any, will be "spent" in 12 months.

Thanks. It’s the freedom pass I’m concerned about. As it would be rather awkward. So I’m just letting that issue lie for now. Yeah they have my contact details. So I’m just waiting for the letter. As to history I’ve been a bit creative but can not recall details as I get around a lot. AnywAy thanks for the reply (just stating the facts) and I’m gonna sit this one out for now.

Just trying to understand the circumstances around how you were challenged. I'm curiuous to know how/why you were challenged at the barriers if you had a ticket from Burgess Hill to Brighton and was only checked at Brighton? As Freedom Passes aren't valid at Brighton anyway, how were they able to deduce that you had not travelled from Burgess Hill and that you had travelled without having a valid ticket for part of your journey?

Knowingly travelling between the edge of the Freedom Pass area and Burgess Hill without a ticket to cover it is evasion and if you were caught they've got you bang to rights. So this suggests as though you incriminated yourself by admitting what you did at the barriers.

Possibly I did incriminate myself. I tried to exit the barriers and was urged to seek assistance.

When asked how to respond to a train company in cases like this the normal advice of this forum is to apologise, say what you have learned from the incident and offer to pay the outstanding fare plus the company’s administrative costs is dealing with the matter.

Given what you have said I can see you might have some difficulty with this.
