Hi,

I got a letter from TfL a few days ago saying that I've been reported 'for failing to produce a valid ticket, pass or photocard on the London Underground'.

The thing is I wasn't even in London on that day. The only explanation is that someone is using my identity.

My car got stolen in beginning of the year which had my driving licence in the glovebox.

I am due to go abroad soon and now I have to deal with this.

What am I supposed to do?? I just want this to be over quickly!!

Reply to TfL stating exactly what you've told us: there is no way it could have been you that was stopped because you weren't in London on that day, but that your documents had been stolen earlier in the year. If you have any evidence to support this then you can supply it along with your letter but it isn't strictly necessary. It is up to TfL to prove that you committed an offence, not for you to prove that you didn't.

In addition to the advice Naja B has given, I would also report the incident to the police force dealing with the vehicle theft, referencing the original crime number. I would give any new crime number to TfL in your response.

It's worth pointing out that because someone has used your details doesn't necessarily mean you have been victim of identity theft in that they have produced your documents when asked; someone may have simply given your details when asked, which will obviously check out when verified by the Inspector as they are real.

The driving licence theft will be on record at DVLA.

Revenue staff will not compare the validity of the driving license against any sort of DVLA database; the name and address will be verified with a generic system just as if it were presented without any sort of ID.

I’d also consider the fact that the person who gave your details may look nothing like you, and the inspector would have noted ‘your’ (your details obviously meaning ‘their’ details) description in his or her notes.
