Virgin Trains can't serve coffee without bags?

The safety policy says scalding hot liquids need to be dispatched in a bag, so they need to be in a bag.

Well if it does, and I have not seen any actual evidence yet, EMT's First Class hosts breach the policy every day.

Or is the policy applicable only on Virgin Trains - in which case, why is it considered more dangerous to carry unbagged drinks on VT than any other TOC ?

A three year old child running into you from behind is going to end up causing you to launch your coffee over a pensioner regardless of how many phone calls you ignore.

How can you be so sure that if a three year old child runs into you from behind there is always going to be a pensioner nearby ?

Safety Policy is not Law. It all depends on who has done the Risk Assessment.
The Law is that each company MUST do a Risk Assessment.

Correction/Clarification to that ^^

The Law is that each Company has to have a Safety Policy.
Therefore each company will do their own Risk Assessment.

However, a company clearing a risk assessment that said 'serving freshly boiled liquids on a moving train without a an additional means of carrying the cup', whilst not illegal, would be very likely to have failed due dilligence should a case ever come to court, I would imagine.

Possibly, but it depends on how well the Risk Assessment has been done and whether the assessor has looked elsewhere. It's a minefield!
