Do you suggest going through solicitor would be better?
As I said, I wouldn't due to the relatively high cost and low impact of a conviction (I would expect a fine for this offence to be less than £200, plus costs).

However only you can decide if the money is worth it.

I concur that a response as outlined by NajaB would be best. A couple more points:

* Should this end up in court you can have the support of a 'McKenzie Friend' - see the guidelines drawn up by the government here. Ideally it would be a friend or family member with some familiarity with the law, or if not the law then any professional work that involves presenting evidence, reasoning and analysis (accountant, teacher, lecturer etc).

* Remember that Magistrates Courts will have a Duty Solicitor, who can represent you for free on the day. If the plan were to plead guilty, the duty solicitor may help you to make a case to the magistrates for a lower fine due to your illness.

* Again, should this end up in court, you could try settling on the day - there's a short summary from an earlier case of how you might do this here.

Would it also be worth sending any correspondence to them by recorded post - so we have a record of it being received by them?

You can send it Special Delivery, but it isn't necessary. The Post Office will give you free proof of postage, and First Class mail is considered delivered one working day later.

Is that still the case? The post office now sell special delivery for next day and say first class is 1-3 days, even trying to make out first class won't get there next day!

I'll double-check but I believe it is - they certainly say it's their delivery aim. It's second working day at the most.
