I'm grateful to Private Eye for bringing this story to my attention, and hope that the publication doesn"t mind me repeating some of its comments here.

York City Council implemented a "bus lane" on Lendal Bridge in the city centre. The implementation was successfully challenged, and a few months ago, a Tribunal found against the City, determining that the signage on the scheme was "ambiguous, inadequate and confusing", and I understand, other defects with the scheme. As a consequence, the City agreed to refund around 50,000 motorists who had been fined after having been detected diving cars in the 'bus lane'.
The Council agreed to refund motorists who had paid the fine.

But now, at a recent Council meeting, the Scrutiny Committee determined that only those motorists who apply for a refund will receive it.

I wonder if anyone will challenge the Glasgow Bus Gate implementation as even Glasgow City Council "accepts that the number of transgressions is unusually high and plans to look at improving the signage in the area to help ensure drivers get the message".

That's been the case every time I've heard about similar incidents in and around London.

Seems like a great way to avoid paying out the bulk of the money taken, as most people wouldn't even know they were entitled to claim a refund and long forgotten about it.

The whole scheme was a bit of a sham. Reducing the amount of traffic in the city should be achieved with incentives, not just cutting off one of the bridges, because it just causes even worse queues through the bus station and city centre.

I can also see how people would have been confused by it, at both ends there's a 90degree turn to get on to it, and if you're a not a local then you won't know which bridge Lendal Bridge is (took me about a year to work it out!). Generally I think York City Council is really good, but it was a failed plan from start to finish really.

I think the local police got caught out a few years (11/12 years) with a very poorly marked temporary speed-limit on the A303 when they got a bit snap happy with a camera catching motorists breaching the 50 limit. Caught out and actually wrote to the people they caught to ask if they would like a refund/points removed.
