I have just applied for trainee driver role with a TOC that has 2 (i think) more years left of running the franchise. I was wondering, what is the situation for staff if the TOC fails to renegotiate the franchise? Such as the situation with National Express / East Coast a year or 2 ago? Do you have to reapply for the position with the new TOC?

Nothing changes except A) Your uniform, and B) Which parent company gets the profits.

I forget the buzzword but there is an agreement with TOCs / Unions / Goverment that staff remain in the same job on the same pay and conditions when a franchised is renewed.

If you think about it... it would be ludicrous to employ an entire fleet of new drivers. Who'd train them...? Who'd drive the trains whilst new employees were in training.. and where would they get the HR staff to recruit them..

There was a thread about this recently (in which I demonstrated my lack of understanding of the railway pension scheme) but apart from that may be of use.

IIRC I believe you have a choice to TUPE or not TUPE

That is the question. Though I see no reason why no one would. Of course all the people at the top of a TOC, if they really are clever enough, wouldve jumped ship to somewhere else within the current franchise owner way before the the results of the winning bid were known.

What else would you do if you didn't TUPE? Am I missing something?

He means as in "to pee or not to pee" but unfortunately it isnt pronounced like that.

I believe it was an attempt at humour.;)

As stated by the others all that happens is you get a new (even cheaper) uniform, normally a management reshuffle and they then try and re-invent the wheel which doesnt work but p1sses the workforce off no end before things go back to normal!
