Wrong name on penalty service

So a friend of mine was taking a train to London Charing cross, with which the ticket was bought with her 16-25 rail card. However, since she got a new phone, her rail card wasn’t on the app or her phone, and she didn’t have the email for the rail card, so she was escorted off the train at London Bridge and was issued a penalty fare notice for “no supporting documentation”.

Her brother was in the same situation back in April, and the penalty had been appealed, so they had his name on the system when they entered her address, to which the staff asked her who that was.

She gave the staff her driving license, and made it clear to them that it’s her brother’s name on their system. However, for some reason on the penalty service site it’s shown as issued to her brother’s name, only with a “miss” title, meaning there was a procedural error on Southeastern’s end and it was issued to a non-existing person.

So if she submits photos of her driving license and rail card to appeal, the name wouldn’t match the “miss brother’s name”, she’s wondering if this penalty is even vaild, and how should she appeal with her rail card when it’s not her name on the penalty.

Why not simply explain this in her appeal? Presumably she wants the matter resolving properly rather than an administration error potentially coming back to create issues in the future?

What happens if I have no battery life or can’t show my Railcard?
A:
If you don’t have any battery life, or have forgotten your device, it won't be possible to check that your Railcard discount is valid.
You could be asked to buy a single ticket for your journey, or be issued with a Penalty Fare.
If you do get caught out while travelling, you can make one claim a year to be refunded for any extra fare or penalty you incur.

The penalty fare was issued to the wrong person and should therefore be appealed. I'm also concerned as to why she was escorted off the train before her destination.

A railway officer is within their rights under Railway Byelaw 24 (2) to remove someone from the railway if they have committed an offence. They can of course purchase a ticket at that station to continue their journey.

Thank you for your response.

This was her first time committing this “offense”, and we are both unfamiliar with penalty fare notices so we weren’t sure whether she can appeal with her name instead of the one the penalty was issued to.

Thank you for this, did not know you can only make 1 claim per year. Will definitely double check whether we have our rail cards on our phones from now on.

You say that this is the first time she has committed this offence: has she committed others at some time?

Thank you, she’s writing up her appeal now, wasn’t sure whether someone can appeal with a name different to the one issued to.

Isn't it the case that a Penalty Fare issued on board can be either to the passenger's intended destination or to the next calling point of the service?

Yes. Usually the latter by default unless the passenger requests otherwise.
