I groaned when that RPI said he can't touch people to wake them up in case he's accused of assault.

It may be personal choice and experience. The accusation can be made but whether it would hold up in court is another matter. However, the matter would probably require investigation and until disproved it would hang over the accused's head and take a lot of their time an effort.
