They don't actually seem to follow these policies.

Especially:

8.3 A prosecution will usually take place unless the public interest factors against prosecution clearly outweigh those in favour of prosecution. The decision whether or not a charge or a case should go ahead rests with the Principle Prosecution Manager and their decision will not be affected by improper or undue pressure from any source.

8.4 If Northern Rail considers that there is insufficient evidence to instigate a prosecution, no prosecution will be brought. Consideration may however be given to other responses, such as to issue a Fixed Penalty or dispose of the matter by way of Formal Warning.

In fact, in most cases where someone has no prior history, Northern seem to issue their "Penalty Fare".

Northern publish a policy with their logo on it, but it doesn't match what their actual policy is.

I seem to recall that this policy appeared around the time that some FoI requests were done to the DfT which put pressure on them to defend their Fixed Penalty Scheme by lying about it to the DfT

I presume they mean "Verification Letter" as in TFL's

"Revenue Prosecutors will send a Verification Letter to all those suspected of fare evasion. The Verification Letter invites the alleged offender to give an explanation for the alleged offence or to provide any comments about the alleged incident."

They don't actually seem to follow these policies.

Some of their policies don't actually match the underlying legislation...but that is for another day.
