Yes, at least one opportunity to get a refund on the new ticket which you buy, not to travel on the discounted ticket by promising to send a picture afterwards.

It's a good job they didn't promise to send a picture then.
The OP clearly stated that the boyfriend had sent a picture AND was on the way with the actual railcard.

I assume the picture was to reassure both the daughter and railway staff that the railcard actually existed.

Did the OP's daughter have the railcard? No. The promise of a railcard (or a picture of one) at some indeterminate time in the future is irrelevant.

The RPI should have sold an undiscounted ticket and explained how the young lady could obtain a refund.

10 minutes isn't some indeterminate time in the future, it's an extremely determinate time in the more or less present. What if she'd been on the train and her boyfriend had her railcard with him at the other end for some reason. Should she be excessed then?

Sorry, but for the RPI it is. They have no way of knowing if it will really be ten minutes or end up being an hour (or if the boyfriend was made up). In any regard the requirement is to travel with the railcard - period.

Thanks to all for you help and advice.

My daughter emailed the Prosecutions Department GWR last night and has already received a reply. (A very quick and impressive response time).

In their words, "I can confirm that we are able to withdraw this case – you may rest assured that we now consider the matter closed."

They even attached a hard copy of a letter they are sending confirming this.

How about this outlandish scenario: the RPI gives the boyfriend ten minutes to get to the station and sees that the OP has made an honest mistake when he arrives with the railcard. Would that really have been so hard? It is called being human. The way to find out if it is really ten minutes is to wait for ten minutes and perhaps even think the best of other people.

I understand that some people might find this hard as they are only capable of following rules to the letter and not behaving with compassion or discretion.

That is a fine principle but it just wouldn't work in practice.

What if, as was the case in the OP, the railcard-less passenger is leaving at that station and just buggers off? How does the RPI enforce the fare due?
