Intention to prosecute - south eastern

Hi all,

I have received a letter from southeastern - intention to prosecute

I was in the wrong and did not have a valid ticket for my journey so I am definitely going to express how much I regret what happened and not make any excuses for it

My question is I do have a severe disability and have the relevant railcard which I used for the journey

The disability is for severe mental / social impairment / autism and I was wondering if this is worth mentioning in my statement

I am just worried this will come across like an excuse which is not my intention, but may explain why I didn’t communicate well with the officer initially

What is this forums thoughts on mentioning disabilities?

Also do south eastern usually offer a settlement before court?

In your other thread you make it clear you were deliberately trying to avoid paying the correct fare. I’ll be presumptuous and assume the same is true here?

So what aspect of your disability makes you fare evade? That’s what you would have to cover in any explanation of why the disability is relevant.

Please upload a copy of the letter you have received, blur out any details that could be used to identify you personally.


In addition answer the following:

• The stations* where you actually started & finished your journey
• The stations* where you changed trains (if applicable);
• If you presented a ticket(s), the information* stated under "Ticket type", "From", "To", "Route", and any other relevant details;
• Details of any Railcard(s) held;
• When and where ticket(s) were purchased, including whether this was prior to the journey commencing;
• What happened in any encounter with railway staff;
• Upload copies of any paperwork (with personal details redacted) with your post.
• We need to know what outcome(s) you would consider satisfactory

Generally Southeastern will accept settlement offers. They have been acting slightly strange towards in recent cases, and there's a chance (albeit slim) they won't even get to your case and it will simply exceed the 6 month statutory limit and they will have to let it go. The last couple of cases involving SE have had this happen.

My opinion on the disability: do you genuinely feel it had any bearing on this ticket irregularity? It's possible you were already 'trying it on' (although I cannot assume what has happened until you describe what happened on the day you were caught) by short-faring? (or whatever the ticket irregularity is in this case). I know if I received such a letter attempting to make a tenuous connection between a disability and a ticket irregularity, I would feel like I was being made a fool of, or perhaps my intelligence was being questioned! If you feel you are 'overdoing' it by bringing it up, I would not recommend it.
