expired railcard

hi there. the other day as i was travelling from southampton central to new milton, and revenue inspection asked to scan my ticket. i had a valid one but then when they asked to see my railcard i realized that my railcard has expired since april 2025… for context, i have only been in the country for 2 years and when i first purchased a railcard it was because i was in college doing full-time education and i had used my father’s card as i had no means to pay for it. the possibility that it has expired has then slipped my mind, but i also had faith that it would / had auto-renew because i didn’t get any reminder that it has expired and whatnot.

upon realizing though, i had admitted to my fault and offered to buy another ticket and pay for the whole fare. i have also prompted to renew the railcard at the moment but was stopped by the inspector and told me that “it would be costly”, so he would just take my details instead and record it. i cooperated and gave him my details. he asked me to sign this paper-like receipt as proof that we had talked on the train. he had folded said paper so all i assumed was that it was for me to pay a penalty fare… when he left and i unfolded the receipt, that’s when i saw that it was a report for prosecution.

i have been ridden with anxiety and have been researching since then. if anyone can offer any advice, i would be so grateful.

(i’ve also taken upon reading similar cases here in the forum so i have a slight idea on what to do but i still feel scared so i decided to post my own experience)

Welcome. You will get the help you need here to deal with this.

They don’t give penalty fares in this scenario because the inspector wants the back office to trawl your on line ticket buying records to see how many other trips you have made with tickets discounted by the railcard after the railcard had actually expired. That will often be more than £50 and they will want to charge you for every such fare to get the money you’ve failed to pay correctly.

Depending on how much travel you have done that could add up.

You need to wait for them to write or e mail you so watch your post and email and spam closely over coming weeks and months.

In the meantime :
Renew your railcard if you are eligible for one.
Trawl your own ticket buying records and make a private list of fares wrongly discounted by the railcard after it expired.

Ask any questions you need to so you clearly understand what will happen next.

Keep that receipt safe as any ref number on it is important.

If you don’t engage with them when they contact you it will automatically escalate to prosecution but you need to seek what is an out of court settlement by paying the fares you owe essentially.

Which railway company was this? SWR?

We do need to know which train company stopped you. The paperwork you were given should hopefully make that clear.

It’s likely you’ll be able to settle out of court, though some companies are more difficult than others. They’re likely to want the undiscounted Anytime fares for all the journeys you’ve made with the railcard since it expired. This fare is £12.70 each way, so each return journey will be £25.40, no discount for a return.

It's almost certainly SWR as only that TOC serves both Southampton Central and New Milton. But if the OP posts an image of the receipt here (with all identifying info redacted, including the reference number) then we'll be able to confirm that.

thank you for replying! and yes, it is SWR. i have also renewed my railcard that same day. i’ll go on to list my previous trips after this. thanks again

For the moment, don't worry too much about the wording: the exact wording only matters if this actually ends up going to court (and for the experts here, it seems to me that SWR are potentially making things difficult for themselves as, to me, intent suggests the RORA offence: it would be easier for the railway to go for a strict liability byelaw 18 charge).

But although the wording doesn't make it clear, what the railway are actually asking for here is for you to
- recognise that you were in the wrong
- convince them that you won't get it wrong again (so that they don't risk any more loss of fares through you making a mistake) and
- offer to pay back the train fare you should have paid, plus the costs the railway has incurred in looking into this matter (so they don't lose money on this incident)

If you can write a letter that will do that, then there is a very good chance that the railway will let you 'settle out of court' - you will have to pay them the train fare you should have paid, plus costs (typically around £150) but that will be the end of the matter and you won't have to go to court.

So what I'd suggest is drafting a letter and letting us see what you want to say before you send it: we'll try to make helpful suggestions to help the railway agree to deal with this out of court. It doesn't have to be very long - 3 paragraphs should do it, saying something like

- what you're writing to them about
- that you're sorry for what happened, and that you will always make sure that you have the right ticket, and a valid railcard
- asking if they would be prepared to let you settle by paying the fare you owe and the costs they have incurred.

Ah sorry this is SWR. If the letter says you can email, just do that, no need to post it too unless you want to be really certain. Our experience suggests emails to SWR work.

hi, everyone! i just wanted to make a quick update that i’ve just received a letter from SWR offering me to settle the matter by paying £132.70, with £120 being the penalty amount and £12.70 for the admin amount. i’ve already paid the amount immediately and only wanted to say thank you to all of your advice and guidance. i’ll make sure to be more mindful in the future with my travel tickets and railcard.

Might these amounts be the wrong way round? £120 admin and £12.70 fares sounds much more nornal

I expect it's a simple admin error, where someone entered the numbers in the wrong order. In any case, the total is correct, and it's good outcome in the grand scheme of things. :)

"Penalty Amount £120"?

I'd probably pay it first, then query it afterwards: You might ask them upon what legal basis they imposed this penalty and quote the DfT;s letter to Northern revealed through FOI, which was clear train companies cannot impose their own penalties, copying in the DfT. Then watch how they attempt to wriggle out in a legalistic way and see if you get your money back.
