Court date set...advice needed please help

Hello all,

An inspector carried out an inspection and she presented her ticket, she was then pulled off the train, informed that what she had done was fraudelent, had to fill out a form with some person who showed her a badge and then purchase another train ticket, before she got back on the train and carried onto waterloo. The inspector was very harsh to her, telling her that she was comitting fraud and that she would get a criminal record for this.

What other ticket does this refer to?

As for the RRA 1889, if your wife wasn't cautioned by the Inspector, I would definately get legal advice, because only RPI's can caution. Under PACE if a defendant is not cautioned then whatever has been said any any "interview" could be classed as inadmissable.

This is not necessarily true, if the passenger is questioned without a caution (for example by a RPA/RPO). The inspector could invite the passenger to sign his/her notebook as an accurate account of events.

I have the details of a solicitor in London who assisted another member last year. This member had an out-of-court settlement of £600-ish and a legal bill of over £1,000. I can provide the solicitor's details by PM if requested, but I cannot warrant or endorse the solicitor other to say that the other member had a successful outcome. He was also looking at an endorsable offence.

I presume you mean recordable offence. They do not put penalty points on your driving license for ticketing offences!
