Hi everyone,

My brother received a Chiltern NIP in May 2025 after an incident in February 2025 where he was found to be using an expired railcard. He has emailed and accepted full responsibility and not heard back. He also has a medical condition which causes significant visual impairment and medical documents from his consultant to confirm that he struggles with reading and this can impact him in all areas.

Just wondering how long they take to respond and the chances of this going to court?

Just wondering how long they take to respond and the chances of this going to court?

They may take several weeks, or even months (max. 6 otherwise prosecution is ruled out.

Chiltern these days are generally willing to settle, but if they investigate his history it may prove costly.

Which type if Railcard was it?

Would a sight impairment of this nature entitle your brother to a disabled person’s railcard? If so this has various benefits over other railcards. But also could perhaps result in a degree of leniency in a case like this perhaps.

It's still unlikely to end up as a prosecution, and more likely to be an expensive out of court settlement, so long as your brother engages fully with the process. Chiltern seems to have a backlog at the moment, we have seen some delays with them. I was also going to ask if it was a disabled railcard - which would perhaps be applicable if he was unable to drive. There are other lines of argument that can be deployed to Chiltern if this is the case.

It was a 16-25 and had expired. We will look into the disabled railcard thank you! Didn’t even think about it

The disabled railcard iirc has much less time restrictions on when it can be used plus a second person travelling with the railcard holder is also given a discount.

Chiltern will almost certainly offer an out of court settlement but they do have a large backlog at the moment so cases are taking longer than normal to resolve.

Note that you don't want to pay a fine! A fine can only be imposed by a court as a punishment upon conviction. What you want to pay is an out of court settlement - it will feel the same as paying a fine but technically it isn't a fine as you haven't been convicted by a court
