    Most inciteful Pedr. Is there no sense that, in creating what confusingly seems like a statutory charge, NR are conflating powers under various different pieces of legislation (Penalty Fares), RORA and the Transport Act. Do they not have to be entirely transparent about what the £80.00 relates to?

    Thx FareCop. The terminology used is Fixed Penalty Notice - their use not mine. We're not going to go to court - I've seen what happens there. It is just now a question of proportionality and whether they would budge on the £80.00.

    Not really, the byelaw stipulates what characterises an offence. The power to fine etc. must come from elsewhere.

    Thank you Moonshot I realise that she has contravened byelaw 18.1 (I think)- that is clear. However, what I am trying to ascertain is the legitimacy of demanding £80.00 and calling it a Fixed Penalty Fine if it is indeed as jcollins not anyrhing of the sort?

    Hmmm - I thought these types of fines were civil rather than criminal offences? If this is a demand for an out of court settlement why have they headed up the letter fixed penalty fine - are they entitled to do that really?
