Carnet problem - solicitor recommendation and any other comments?

Don't misunderstand me, I am pleased.

Carnet problem - solicitor recommendation and any other comments?

I know why my solicitor has not challenged this. No instructions to do so were given by me because challenging it wouldn't be cost-effective. For what it's worth, the administration fee doesn't bother me. I'd rather not have to pay it but agree with LlaniGraham that GAdid incur an...

    Sending a cheque

I just paid Greater Anglia by bank transfer. Their letter says specifically that it is OK but asks you to contact them to let them know if you pay that way so that they can look out for it. This should not really be necessary (and in fact probably means it's no less trouble than sending a cheque...

Carnet problem - solicitor recommendation and any other comments?

By way of update: Following Dave's excellent advice about how, if I would hire a solicitor once I was out of my depth then doing so now might stop me getting there, I contacted a solicitor (not a railway specialist but someone working in criminal law locally), we obtained copies of the...

In case it helps any in terms of how long you might be waiting, in my case GA took about 2 weeks to write to me after they had taken my details, then I wrote back and they took a month to get back again. In another thread on this board, they took 2 weeks from the passenger's letter. Neither of...

    Reused carnet

Thanks. Not reassuring that they are struggling both with systems and consistency but not surprising either, and useful to know anyway. Wish they'd hurry up, though.

    Reused carnet

Good to hear this. Also in relation to a carnet issue, I have been waiting 3-4 weeks for Greater Anglia to get back to me or my solicitor now. Perhaps they will reduce their backlog a bit soon ... I agree with you about using a lawyer taking some of the stress out of it, though.

Intent to prosecute letter - reusing carnet - Please help!

In my case, if it were a criminal offence, the same point would arise and the question would again be whether it was invoked, so probably not but it's strange that there is no differentiation at all between different types of offence. Might need to see if I can get that changed when this is over ...

Intent to prosecute letter - reusing carnet - Please help!

It is not so different for me. I work under a contract that can be ended if I am guilty of a criminal offence. I don't think a railway bylaw offence is what the writer had in mind and probably it won't be invoked but it would be better not to have to find out.

Thanks Dave; I think I got confused before. That does help me quite a bit.

Carnet problem - solicitor recommendation and any other comments?

Hi. I am making progress but would like to understand the byelaws a bit better. If I understand the principle correctly, they are strict liability, i.e. if you did it, you did it and doesn't matter why. I can follow that for byelaws 17, 18, 19, 21 and 22 because they simply define things that...

Carnet problem - solicitor recommendation and any other comments?

Thanks to everyone for these comments TonyR - not being able to write on the ticket properly with a ballpoint pen and having to have a few goes is indeed what happened to me. My carnet looked about as good as the one you posted too. Amateur - I also bought mine in person but I don't see...

"Confused" is a good description. Thank you; I will take that on board.

Carnet problem - solicitor recommendation and any other comments?

Hello. My letter from the Greater Anglia Prosecutions Department arrived today. Unfortunate timing as I am just about to go away for a few days for work purposes, but at least after the comments that people have made here, I am reasonably well prepared. The letter reads: "On [DATE] at...

Carnet problem - solicitor recommendation and any other comments?

Mmhm. And strangely, German S-Bahn stations have had exactly those machines for many years. Old technology compared to Oyster-type touch-in/out, but still effective ...

Carnet problem - solicitor recommendation and any other comments?

Sure, good point, so whoever writes the rules has to make them general enough that they deal with travellers from many countries. I was able to find some information about what sort of things definitely have to be declared, especially crimes of "moral turpitude", and it is all much heavier...

Carnet problem - solicitor recommendation and any other comments?

Thanks Dave, this is helpful. I am not surprised that "intent" is a topic of debate at higher levels! But meantime at my lower one, it is really useful to know that a byelaw offence does not lead to an entry on the criminal records database. This is reassuring in a lot of ways but do I...

Carnet problem - solicitor recommendation and any other comments?

Sure. I don't agree but I don't make the rules. --- old post above --- --- new post below --- Sorry, me again ... You have explained that a byelaw offence does not carry a criminal record but is it still legally a "criminal offence"? Dave's post said it was a criminal matter so I assume yes...

Carnet problem - solicitor recommendation and any other comments?

Well, I meant to make a new post with a quote but in the end I got an edited one with a sort-of quote. So I am almost as good at this as at filling in tickets! This is useful, thank you. In fact the conditions of the carnet don't seem to say exactly that, just that it has to be validated in...
