I agree Chris. I'm assisting my son in his forthcoming appearance in court for the same thing. The Inspector has lied in his statement, he wore a bodycam, yet makes no reference to it...it may not have been switched on, but why not? Neither does his statement even mention that my son asked him...

It isn't at the "inspector's discretion", since the website specifies 'The course of action taken depends on the circumstances'. The question is which circumstances determine action? Something obvious, like trying to hide from the conductor or inspector, would result in a larger fine or court...
