Can you use the return portion of a day return ticket if you do not use the first outward journey ticket?

Yes but you can reduce gas, electric usage, its much harder to replace a commute, but it can be done. I just get up really early now and get the bus.

The point is that if you reduce your usage of everything to whatever you perceive the minimum to be and you still can't afford it the railway is seen as a better opportunity for avoiding paying than the gas and electric

Yeah not denying it is easier to fare evade than siphon off gas/electric (probably because it requires much more skill to do the latter). I think we are agreeing on my point that affordability/money is the main reason for fare evading. Its the reason why middle/upper class people are often believed that it is a one off, and others are assumed to be serial fare evaders. It's genuinely really noticeable in the disparity of how different classes are treated by the rail staff, from what I have witnessed anyway. I dont have stats to back it up.

I'd be pretty surprised if there was no correlation between increased ticket price and fare evasion. Watching the show, almost all evaders cite money as the reason for the evasion.

And if you cant find the information for uk, how can you know it is as much of a problem elsewhere?
My experience on continental trains is that ticket checks are much more frequent and happen on many more journeys than they do here. This provides a disincentive to fare evasion on longer journeys. On metros, buses and trams your chance of getting caught is much less so fare evasion is probably higher.

I suspect that levels of fare evasion are linked to the perceived chances of getting caught. If people think they will get away with it they are likely to try it on whether fares are high or low.

This is sadly true all across society. I have actually technically been an illegal immigrant in another country due to a visa error, and got nothing more than a ticking off and a request to resolve it promptly, which having done that I was allowed back in with no problems. I suspect the colour of my skin, my country of origin and my professional job are the reasons why this was the case and why I was not deported and banned from said country. Though there are countries (e.g. the US and Australia) which wouldn't be as nice, whatever my origins!

Yeah it's quite refreshing when we can talk openly about this, the underpinning classism, racism and other forms of bigotry which do exist in our society is what concerns me so much with such a subjective, 'consent based' ticket inspecting process. It has been the single most well known issue in the police force, treating people as more suspicious based on charactersitics they cannot change. And at least because it is known, there are checks to make sure minority groups are not unfairly stopped, questioned, harrassed etc (not that that stops it completely).

I guess an easy way to test this would be to compare fare evasion on the cheapest line, with fare evasion on the most expensive.

In my case, the ticket inspector walked off down the train and fined 2 other people after me. He followed the process and procedure completely with them, printing out paper tickets for them to get through the gates. I dont know why I was treated so differently but I can only assume my autism is a part of it, and I just do not think that's fair.

It sounds a bit like they were probably issued with Penalty Fares which are used for fairly simple cases of non-fraudulent ticketing issues, such as just forgetting to buy a ticket. In your case what he should have done if he suspected misuse was created a Ticketing Irregularity Report (which I think results in a bit of paper called an MG11, unless I'm getting confused) but for some bizarre reason didn't do so. I do find it very strange.

An MG11 is a witness statement, not a TIR.

The withdrawal of both portions is allowable here. The return portion was used and therefore the outward had no residual validity, so both can be confiscated and the only reason to be aggrieved is if one was intending to us the outward on the return!

They should have been issued a receipt though showing the confiscation, though no zero fare ticket was necessary to issue owing to the logic in the previous paragraph.

I dont think this subjectivity should be allowed to be honest, are there clear guidelines on how guards know how to determine between suspected misuse and genuine ticket mistakes? I would really like to read it.

If these guidelines do not exist, how do we know inspectors dont just treat people differently based on other factors, such as personal bias, or communication difficulties due to neurodivergence?

It's just not factually true. My ticket was for beyond the station the train was pulling it to, I had to change and get further trains which I wasnt able to do because he took my ticket. So please, please do not make assumptions about me when I have spent the entire morning writing about how I find it morally dangerous that ticket inspectors do this.

and this really just proves my entire point. Alterego you have just made a completely baseless assumption of why I was upset my ticket was taken from me and I cannot express how much I do not appreciate that. It is genuinely exhausting to be treated like this, and this is why I will not pay a single cent to the train companies again.

How would anyone reading this thread know that? And your previous thread appears to be hidden so there is no way for anyone to refer to that either.

You can't actually be penalty fared in your situation because you presented a ticket which was valid absent any other evidence. A TIR is the correct form of action; this can be done for all sorts of reasons and it not necessarily an allegation or assumption of guilt. A TIR basically means they get to withdraw the ticket to inspect it further and if there is any other investigation to be done like auditing other purchases they will do this. A TIR can also be issued when a retailer has improperly issued or printed a ticket for example.

If these guidelines do not exist, how do we know inspectors dont just treat people differently based on other factors, such as personal bias, or communication difficulties due to neurodivergence?
There may well be unconscious bias at play of course, but this is really moving away from your original query.

@Haywain Why is it assumed that the only reason I could possibly be sad at my ticket being taken is because I am a fraudulent criminal? I kindly ask you to stop replying to my thread now since your only input is constantly trying to nitpick things I say, thankyou.

I don't believe I have made any such assertion. It's more what you have chosen to read into my comments.

Well, this is a public forum so you don't get to make that choice. If you have concerns about my posts there is a process for reporting them for moderators to investigate but I am confident that I have not posted anything that might be considered out of order.

Of course not, but I do get to chose to use my words to kindly and respectfully ask that you don't.

You were born to be a ticket inspection agent.

I dont have cause to report you, that would be completely unnecessary.

You have not provided a single piece of valuable advice or information throughout this entire thread, you have just nitpicked and 'but!' everything I say. It's very tiring and cant be a good use of your time.

I hope you have a more productive day.

Unfortunately that is one of the messy elements of human nature. As is interpreting other peoples’ motives.

I just really dont think criminal records and the likes should be as messy as this. I really think the gov needs to look into standardising it across the country, if its strict liability, it should be strict liabilty. No room for subjectivity and bias.

You aren't exactly helping yourself with your constant evasion of the core questions identified quite early on by experienced forum members. If you want help then you need to tell people exactly what your circumstances are and answer any queries people have which are crucial to your case. I'm not sure what you expect people to say when you deliberately skirt around crucial questions over behaviours known to be common with that of a typical fare evader and then spend the last few hours talking about broad policy issues which aren't going to be directly helping your case. Most experienced forum members have no connection to the operators and have no personal agenda against you. Most are equally appalled at some of the behaviours from various operators, and are only trying to eliminate possibilities which would be detrimental to your case as you have given no clarification so far. Until you help them understand your situation in full no one will be able to offer you useful advice. If instead of asking for help, all you need is to have a rant and let off steam, that is OK too, just make it clear so people don't have to second-guess your intention.

The bottom line is, if you did nothing wrong, the operator cannot successfully obtain a conviction as they won't have the necessary evidence. If you were in the wrong then come clean, no one is going to make a big fuss out of a one-off offence (except TfL perhaps) provided you communicate with them with the right attitude. If you think the member of staff did you wrong, then register a complaint and wait for their response. Don't get yourself worked up about it. If you feel strongly about policy issues there are various passenger rights campaign groups you can join, or even start one yourself if none takes your fancy.

I'm only on about the outbound ticket which the train company's staff suspected was going to be used on the return later that day, and indeed the ticket was withdrawn basically for the purpose of auditing any previous purchases so previous losses could be analysed. That is what happened and that is why you are where you are now.

As your position is that you were never going to use it, and we all accept it has no value, why would you be annoyed at that portion being withdrawn? As I've said upthread *a receipt should have been issued* (this would have enabled you to complete your journey into London), but the withdrawal of both portions was lawful and proportionate. You have a legitimate grievance with not being given a receipt to complete your journey into London, of course.

But we are once again litigating your original grievance, without the assistance of the original thread which has been hidden. This is very unhelpful for everyone - because all the context is missing.

This is not likely to be a criminal matter, but a civil one, as I keep repeating.

Maybe take a step back and read some other threads where people are straightforward and open and you will see that assistance is easy to get. Evasiveness and anger are not helping anyone, least of all you, because you're the one in trouble here stewing more about every type of injustice. I am the one taking my free time on a forum to try and help people defend themselves or get money back while I am in Poland eating pierogi for lunch and also trying to sort my kid's nursery place for tomorrow as I am suffering travel woes.

All criminal records are subject to the vagaries of human bias - even murder. At that extremity far more checks and balances are in place, but as countless examples show, even they are not foolproof.

I dont need you to know all the context, I just asked a simple question about the legality if travelling on a return portion and people remembered me and started nitpicking again. Someone else advised not to post details publicly so I also do not want the paranoia of thinking the guy who took my tickets is reading everything I say.

As stated, I was annoyed because they were taken with no explanation given (this is not an exaggeration or lie). He did not give me any paper ticket, and I had to rebuy tickets to carry on my journey. I was not annoyed because I wanted to use the ticket to come home.

Im well aware of the criminal system, undeniably the TOCs are operating in grey areas without oversight or even legal training though. I still think it should be standardised.

Yeah that wasn't a helpful post from that member. There have basically never been negative consequences from anyone posting full and frank details here, and the inspector isn't the one who decides any action here. It's people in the back office.

Only once case ever resulted in negative consequences. It's this one https://www.railforums.co.uk/thread...-chiltern-and-a-lying-ticket-enforcer.260977/ and the company decided to prosecute the case (which was then settled out of court for a much larger sum than the original offer) because the OP told fantastical lies. The response from the company indicates they had read the forum.

Train companies are familiar with all the things people get up to and SWR deal with them in a pragmatic way, but only when people are cooperative with them (which is nearly all the time from people who come from this forum becuase it is our advice and we help them write letters). Our advice is always to be truthful though there are aspects of cases where it may always be better to use one's right to silence eg: "I wouldn't mention that bit if I were you".

If SWR were to audit your past purchases and ask you about them, my advice would be not to reply, because my take is that you replying would not be in your best interests.

Advice can only be given properly when we know all the full circumstances of a case. In the same way you shouldn't waste a defence solicitor's time by being vague or evasive, you should provide clear and accurate information so posters who are being asked to help can give the best help they can. You should also be aware that your case will be assessed by people who will use neurotypical thought processes and who will infer intent or action from evidence available. Neither you nor the train company have an automatic right to be believed in the legal process.

These are important things to bear in mind.

thanks this was really helpful.

I think there's a risk people mistake the legal advice they get on here with encompassing legal privilege, which obviously does not apply on a public forum, so I do disagree that it's at all comparable posting on here to speaking with a solicitor. Not to doubt everyone's expertise, but how can a poster ever know the true intentions of people asking identifiable questions now that it is established revenue teams regularly read this forum and adapt their strategies accordingly. I cant think of any legal consequence of someone who works for the TOC purposefully trying to get information sneakily out of someone posting and that changing the course of the investigation, so it is possible it happens.

Edit: the above is my thoughts after reading that linked thread.

I know for fact that my ticket of travel was valid and I have never travelled without one.

As it seems clear your principal concern is that anything you say in the forum can and will be used against you it will inhibit the quality and usefulness of any advice given. If you need dedicated and privileged advice you need to go to a solicitor.

I have no reason to go to a solicitor, just wanted confirmation that my tickets were valid, which they do indeed seem to be.

In a small number of cases where the return fare from A to B is cheaper than the single fare from B to A due to various reasons then if you buy a return ticket from A to B, throw away the outward portion and simply use the return portion to travel from B to A then yes that will be valid.

What isn't valid is trying to use the outward portion to travel back to A later in the day. If using etickets it will flag up when scanned, the wording is something along the lines of "return used at station B at XX:YY".

However if the single fare from B to A is cheaper than the return fare from A to B, then why waste money on buying a return ticket when you are not using the outward part.

Yes I would have thought it would clearly flag, and in fact I believe the outward part of the ticket wouldnt even scan correctly to let you through the gates?

It is more a question of, if one accidentally buys a return ticket the wrong way round, why waste money buying a whole new return when you could use the return as a valid ticket and then travel back on a separate new single ticket or a coach (either would be cheaper than a whole new return).

Depends if it's a paper ticket or an eticket due to the limitations of what can be encoded; did you not get any errors or rejections at all and were you permitted to board without hindrance?

Were you using a paper ticket or an eticket? And no error codes like "return already used" or "not valid at this time"? That seems like a big issue with the gates at Waterloo to be honest if they are permitting travel with what is supposed to be an invalid ticket.
