I’m interested to know whether any other EMR season ticket holders have experienced this with Delay Repay.
I have an annual Smartcard season ticket for travel into London.On the day in question there was significant disruption to EMR services into London, with all trains cancelled.
Before leaving home I checked the live train information on the train app, saw the extent of the cancellations and disruption and therefore didn’t travel to my home station.
I subsequently submitted a Delay Repay claim, which EMR have rejected for the following reason:
“We have not been able to approve your claim as it appears the smartcard provided was not used on the date being claimed for.
When a Smartcard is used for travel, we expect to see the card used to tap in and out at either end of a journey. However, upon reviewing the tap in and out data on your Smartcard, we cannot see that it was used at time or date of the journey on this claim.”
This seems completely illogical to me. The reason there is no tap-in data is because I checked the service before leaving home, saw that EMR had cancelled the trains and therefore didn’t make a pointless journey to the station simply to tap my Smartcard.
I have already paid for my travel through my annual season ticket, and EMR obviously have their own records showing the cancellations and disruption on the day.
I have appealed the decision, but I find it ridiculous that I’m having to appeal in the first place. Are season ticket holders really expected to travel to the station and tap in even when they already know their train has been cancelled, simply to preserve their ability to make a Delay Repay claim?
Has anyone else with an EMR Smartcard/season or any other train company had claims rejected for the same reason, and if so, what happened when you appealed?
