Delay repay with 1st class supplement

More out of curiosity than the money involved.
Trip Berwick upon Tweed to Edinburgh via TPE 1st class Advance
Edinburgh to Glasgow via Scotrail Anytime, standard class with £5 1st class upgrade purchased onboard.

TPE train delayed meaning I caught a later Scotrail than intended.
So delay repay claim being claimed against TPE.

Question: should the 1st class upgrade cost be part of the delay repay claim?

Yes, first class upgrades are fares and are therefore eligible for Delay Repay just as much as it you held a through first class ticket.

I'm not sure about this one.

The £5 supplement could only have been bought on board the ScotRail train, i.e. it's a discretionary additional expense after the extent of the delay was already known to the OP.

Of course there would be no problem if the OP held a first class ticket on ScotRail before commencing their journey.

Yes, I did wonder about this as well, i.e. purchasing the supplement after the known delay, therefore knowing it would be refunded.

But if you can only buy on board, and no opportunity to before hand, which you would have done purchased regardless of the delay, then it seems you have lost out.
