However, think the fear of liability, litigation, compensation, reputational damage must weigh pretty heavily on the minds of railways.
The inconvenience to every other customer of suspended /cancelled services must also be a big factor.
The legal and insurance implications, potential litigation, line closure both on the day and potentially long term closures and resultant disruption to all the other travellers have to override the wishes of those few who want to stick their heads out of the window. That is just the way it is...
